Amendment #409 to H3400

An act to exempt municipalities from gas tax

Mr. Lombardo of Billerica moves to amend the bill by adding the following section:-

“SECTION XX.  Section 12 of chapter 64A of the General Laws, as appearing in the 2012 Official Edition, is hereby amended by adding the following paragraph:-

Notwithstanding any general or special law to the contrary, any sale of fuel, including but not limited to unleaded gasoline and diesel fuel, by a distributor duly licensed in the commonwealth to the commonwealth, a state agency, a municipality, or a municipal agency shall be exempt from the tax per gallon imposed by this chapter.”
