Amendment #698 to H3400

Traffic Mitigation Funds

Representatives Stanley of Waltham, Kuros of Uxbridge, Provost of Somerville, Ashe of Longmeadow, Dwyer of Woburn and Gordon of Bedford move to amend the bill by adding the following section:

"SECTION XX.  Section 9 of chapter 40A of the General Laws, as appearing in the 2012 Official Edition, is hereby amended by inserting after the second paragraph the following paragraph:-

Zoning ordinances or by-laws shall provide that the benefits of any improvements, amenities, funds or other conditions required for the granting of a special permit shall not be limited to use or application in only the immediate vicinity or zone of the development for which the special permit is required and that such benefits may be used throughout the municipality in which the special permit granting authority is located."
