Amendment #935 to H3400

Massachusetts Commission Against Discrimination

Representatives Farley-Bouvier of Pittsfield, Madden of Nantucket, Keefe of Worcester, Provost of Somerville, Rogers of Cambridge, Rushing of Boston, Puppolo of Springfield, Khan of Newton, Fox of Boston, Ashe of Longmeadow, Devers of Lawrence, Decker of Cambridge, Lawn of Watertown, Schmid of Westport, Malia of Boston, Hecht of Watertown, Honan of Boston, Tosado of Springfield, Holmes of Boston, Gonzalez of Springfield, Vega of Holyoke and Carvalho of Boston move to amend the bill in section 2, by striking out item 0940-0100, and inserting in place thereof the following item:

"0940-0100   For the operation of the Massachusetts commission against discrimination; provided, that all positions except clerical shall be exempt from chapter 31 of the General Laws; provided further, that the commission shall pursue the highest allowable rate of federal reimbursement; and provided further, that the commission shall work with the office of access and opportunity and the office of diversity and equal opportunity to design and deliver training to executive branch staff; and provided further that pursuant to the fifteenth paragraph of section 3 of chapter 151B of the General Laws, the commission shall be permitted to set, charge and retain all fees and costs assessed or incurred delivering training to executive branch staff pursuant to the requirements of this item …….$ 3,058,237";

and by striking out item 0940-0101 and inserting in place thereof the following:

“For the Massachusetts commission against discrimination, which may expend not more than $2,468,911 from federal reimbursements received in fiscal year 2016 and prior fiscal years for the purposes of the United States Department of Housing and Urban Development fair housing programs and the equal opportunity resolution contract program; provided, that notwithstanding any general or special law to the contrary, for the purposes of accommodating discrepancies between the receipt of retained revenues and related expenditures, the department may incur expenses and the comptroller may certify for payment amounts not to exceed the lower of this authorization or the most recent revenue estimate, as reported in the state accounting system……..$ 2,468,911”;

and striking out item 0940-0102 and inserting in place thereof the following:

“0940-0102 For the Massachusetts commission against discrimination, which may expend for the operation of the discrimination prevention training program an amount not to exceed $240,000 from revenues collected for providing discrimination prevention training and certification, and from all other fees or costs assessed or incurred by the commission…….$240,000”.
