Amendment #1102 to H4200

Representatives Barber of Somerville, DiZoglio of Methuen, Fox of Boston, Gentile of Sudbury, Gonzalez of Springfield, Gordon of Bedford, Heroux of Attleboro, Khan of Newton, Rogers of Cambridge, Sannicandro of Ashland, Scibak of South Hadley, Toomey of Cambridge, Ultrino of Malden and Walsh of Framingham move to amend the bill in section 2, line item 7004-0101 by striking the words, ”provided further, that as a one-year pilot program, the department may expend not more than $300,000 under item 7004-0108 on families residing in time-limited temporary emergency shelters and residential treatment programs under items 4512-0200, 4513-1130, and 4800-0038 if such families otherwise meet all eligibility requirements applicable to emergency shelter under item 7004-0101, except that, solely for the purpose of item 7004-0108, the fact that a family is residing in a temporary emergency domestic violence shelter under items 4513-1130 or 4800-0038 or in a residential treatment program under item 4512-0200 shall not preclude such family from receiving assistance; and provided further, that any unit in such temporary emergency shelters or residential treatment programs under items 4512-0200, 4513-1130, or 4800-0038 vacated through use of funds under this pilot program shall be filled by a family (i) eligible both for emergency shelter under item 7004-0101 and for entry into such temporary emergency shelter or residential treatment program under item 4512-0200, 4513-1130, or 4800-0038 and (ii) referred to such temporary emergency shelter or residential treatment program under item 4512-0200, 4513-1130, or 4800-0038 by the department”

 

And further amend by inserting in 7004-0108 after the words, “shall not become ineligible for assistance due to exceeding the income limit for a period of 6 months from the date that the 50 percent level was exceeded; the following words, “provided further, that families who received the maximum amount of household assistance in a prior 12-month period, who complied with their rehousing plan during the prior period of assistance, who continue to include a child under the age of 21 or a pregnant woman, and whose gross income does not exceed 50 percent of area median income or who have not had income in excess of said 50 percent level for a period of six months shall be eligible for further allotments of up to $8,000 in household assistance in subsequent 12-month periods to prevent their eviction from their existing housing or to relocate to another housing situation, without needing to first be evicted from their existing housing or otherwise needing to establish that they fall into one of the four categories of affirmative eligibility for emergency assistance shelter listed in item 7004-0101;”

 

And further amend by inserting in 7004-0108 after the words, “nothing in this item shall give rise to or shall be construed as giving rise to any enforceable right or entitlement to services in excess of the amounts appropriated herein; and provided further,” the following words, “that household assistance funds shall be advanced to the administering agencies at the end of each month and prior to the next month's disbursement, the amount of which shall be estimated based on the prior month's expenditure with a reconciliation not less than annually and provided further, that as a one-year pilot program for FY 2017, the department may expend  funds under item 7004-0108 on families including a child under the age of 21 or a pregnant woman who meet income eligibility requirements for emergency shelter under 7004-0101 or this item but who are residing in time-limited temporary emergency shelters and residential treatment programs under items 4512-0200, 4513-1130, and 4800-0038;”

 

And further amend by striking the figure, “$31,943,664” and inserting in place thereof, the following figure, “$39,200,000”.
