Amendment #290 to H4200

Direct Funding for Transitional Charter Costs

Mr. Ryan of Boston moves to amend the bill in section 2, by striking out item 7061-9010, and inserting in place thereof the following item:-

 

“7061-9010 For fiscal year 2017 charter school tuition and the per pupil capital needs component included in the charter school tuition amount for commonwealth charter schools, as calculated pursuant to subsections (ff) and (gg) of section 89 of chapter 71 of the General Laws; provided, that notwithstanding said subsection (ff) of said section 89 of said chapter 71 or any other general or special law to the contrary, the per pupil capital needs component of the commonwealth charter school tuition rate for fiscal year 2017 shall be $893…$85,500,000”;

 

and by inserting the following 3 sections:-

“SECTION XX. Subsection (ff) of Section 89 of Chapter 71 is hereby amended in the fourth paragraph by inserting after the “year” the following words:-

, minus the sum calculated under subsection (gg) of this section

 

SECTION XX. Subsection (ff) of Section 89 of said Chapter 71 is hereby amended in the ninth paragraph by striking the first sentence and inserting in place thereof the following sentence:-

The department shall provide funding directly to all charter schools for the per pupil capital needs component of the total charter tuition costs.

 

SECTION XX: Section 89 of said Chapter 71 is hereby amended by striking subsection (gg) in its entirety and inserting in place thereof the following subsection:-

(gg) Annually the Department of Elementary and Secondary Education shall certify the projected cost of each districts’ maximum enrolled charter school seats, based on the district’s most recent average charter school tuition rate not including the facilities rate. The commonwealth shall incur 100 per cent of the total charter school tuition amount that is greater than the district’s total charter school tuition amount for the previous year in the year in which the increase occurs; the direct funding amount shall be equal to 100 per cent of the increase in the year in which the increase occurs and 50 per cent in the second year and 25 per cent in the third year.  Said portion of charter school tuition shall be paid directly from the commonwealth to the charter school and shall not be deducted from the total state school aid, as defined in section 2 of chapter 70, of the district in which the student resides.”
