Amendment #300 to H4200

Safe Urgent Care

Ms. Garlick of Needham moves to amend the bill by adding the following 6 sections:-

 

SECTION XX. The definition of “Expenditure minimum with respect to substantial capital expenditures” in section 25B of chapter 111 of the General Laws, as appearing in the 2014 Official Edition, is hereby amended by inserting after the words “other than ambulatory surgery” the following words:-

 

or urgent care that is not affiliated with an existing acute care hospital in said hospital’s primary service area,

 

SECTION XX. The definition of “Substantial change in services” in said section 25B, as so appearing, is hereby amended by inserting after the words “other than ambulatory surgery” the following words:-

 

or urgent care that is not affiliated with an existing acute care hospital in said hospital’s primary service area,

 

SECTION XX. Said section 25B, as so appearing, is hereby further amended by adding the following definition:-

 

“Urgent care”, medical services required promptly to prevent impairment of health due to symptoms that a prudent lay person would believe to require medical attention, but are not life threatening and do not pose a high risk of permanent damage to an individual’s health whether provided in an acute care hospital or in a free standing urgent care center licensed as a clinic pursuant to section 51. Urgent care does not include elective or primary care.

 

SECTION XX.  The second paragraph of section 51 of said chapter 111, as so appearing, is hereby further amended by striking out the words “or a clinic providing ambulatory surgery as defined by section twenty-five B,” and inserting the following words:-

 

, a clinic providing ambulatory surgery as defined by section twenty-five B, or a clinic providing urgent care as defined by section twenty-five B that is not affiliated with an existing acute care hospital in said hospital’s primary service area,

 

SECTION XX.  The definition of “Clinic” in section 52 of said chapter 111, as so appearing, is hereby amended by inserting after the word “rehabilitation,” in both instances in which it appears, the following words:-

SECTION XX. Said definition of “Clinic” in said section 52, as so appearing, is hereby further amended by striking out the words:-

"a medical office building, or one or more practitioners engaged in a solo or group practice, whether conducted for profit or not for profit, and however organized, so long as such practice is wholly owned and controlled by one or more of the practitioners so associated, or, in the case of a not for profit organization, its only members are one or more of the practitioners so associated or"
