Middleborough Agricultural Society

Ms. Cronin of Easton moves to amend the bill by adding the following section:- "SECTION XXX. Notwithstanding chapters 128A and 128C of the General Laws, and any other general or special law to the contrary, at any time the commission may grant a running horse racing meeting license to the Middleborough Agricultural Society in connection with a state or county fair that it may conduct during calendar years 2016 and 2017, with a maximum of fifty (50) days of racing during each calendar year and with simulcast wagering. No simulcast premium payments, host track fees, payments intended for purses at other race tracks in the commonwealth or any other payment shall be payable by the Middleborough Agricultural Society to any other racing meeting licensee, and no other racing meeting licensee shall be required to pay the Middleborough Agricultural Society any simulcast premiums, host track fees, payments intended for purses at live races conducted by the Middleborough Agricultural Society or any other payment.  From simulcast wagering the Middleborough Agricultural Society shall pay to the commission, on behalf of the commonwealth, the same amounts that the running horse racing licensee in Suffolk county would be required to pay to the commission and commonwealth if said Suffolk county licensee conducted simulcast wagering, excepting payments that said Suffolk county licensee would have paid into the capital improvement fund and promotional fund, and no other amounts shall be payable.  For all live races conducted by the Middleborough Agricultural Society it shall pay to the commission, on behalf of the commonwealth, the same amounts that the running horse racing licensee in Suffolk county would be required to pay to the commission and commonwealth if said Suffolk county licensee conducted live races, excepting payments that said Suffolk county licensee would have paid into the capital improvement fund and promotional fund, and no other amounts shall be payable.  The commission may approve any purse agreement between the Middleborough Agricultural Society and the horsemen’s association that represents the horse owners that will be racing and where the purse agreement may provide for a percentage of such purses to be paid to the Middleborough Agricultural Society."
