Amendment #849 to H4200

Clarification Relative to MassDOT Employees

Representatives Wagner of Chicopee and Muradian of Grafton move to amend the bill by adding the following section:

SECTION XXXX.  Notwithstanding the provisions of any general or special law to the contrary, the personnel administrator (HRD) shall certify any active employee who was either transferred under chapter 25 of the acts of 2009 to, or is serving provisionally or by emergency appointment in, a labor service position in the Massachusetts Department of Transportation on April 30, 2016 to permanent civil service status in that position; provided, however, that any employee not serving in the position for at least six months immediately prior to April 30, 2016, shall serve a probationary period as provided by section 34 of chapter 31 of the General Laws.  The civil service seniority date shall be the first date of service in the position but not before November 1, 2009.
