Blue Pencil Modification of Noncompetition Agreements

Mr. Toomey of Cambridge moves to amend the bill in Section 3, in line 210, by striking subsection (d) and inserting in place thereof the following subsection:-  “(d) A court may, in its discretion, eliminate any unreasonable or unenforceable provisions of a noncompetition agreement, but it shall not add terms or rewrite any provisions to render the agreement or its provisions valid and enforceable.”
