Redraft Amendment 4

Re-homing: elements of crime and available penalties

Mr. Brownsberger and Ms. Creem move to amend the bill by deleting lines 98-104;

by striking the letter “(d)” as it appears in line 105 and replacing it with the letter “(c)”;

by adding the words “who has executed an acknowledgement of the criminal penalties available under this section and” before the word “who” in line 105; and

by striking the words “the state prison for not more than 20 years and by a fine of not more than $25,000”in line 107 and replacing them with the following:-

“jail or a house of correction for not more than 2 ½ years or in the state prison for not more than 5 years, or by a fine of not more than $25,000,  or by both such fine and imprisonment”.
