Criminal Liability for Second Offenses

Mr. Brownsberger moves to amend the bill Mr. Brownsberger moves to amend the bill by striking the words “less than $10,000 and not more than $40,000, or by imprisonment in jail or house of correction for not more than 2 ½  years or in the state prison for not more than 5 years, or by both such fine and imprisonment” in lines 102-104 and replacing them with the following:-

“more than $5,000 for a first offense and, for a second offense, by a fine of not more than $25,000 or by imprisonment in jail or house of correction for not more than 2 ½  years or in the state prison for not more than 5 years, or by both such fine and imprisonment;

And by striking the words “imprisonment in the state prison for not more than 20 years and by a fine of not more than $25,000” in lines 106-107 and replacing them with the following:-

“a fine of not more than $5,000 for a first offense and, for a second offense, by a fine of not more than $25,000 or by imprisonment in jail or a house of correction for not more than 2 ½ years or in the state prison for not more than 5 years, or by both such fine and imprisonment”.
