Presumed Violation

Messrs. Tarr and Ross move to amend the bill in Section 3, by striking in subsection a, in line 14, the sentence, "An operator of a motor vehicle who holds a mobile electronic device to, or in the immediate proximity of the operator’s head while operating such vehicle shall be presumed to be in violation of this section."  and replacing it with the following:-

“Operating a motor vehicle with a mobile electronic device to, or in the immediate proximity of the operator’s head may be considered evidence of a violation of this section.”
