Waste-to-energy operation date

Mr. Pacheco moves to amend the amendment in section 5, by striking out, in lines 35 and 36, the words “regardless of the commercial operation date of the waste-to energy facility”; and by inserting after section 18 the following section:-

“SECTION 18A. Waste-to-energy shall be eligible under section 5 regardless of the commercial operation date of the waste-to-energy facility; provided, however, that the facility shall have been in operation as of January 1, 2016.”.
