“SECTION ____. The General Laws, as appearing in the 2014 Official Edition, are hereby amended by striking out chapter 90I in its entirety and inserting in place thereof the following chapter:-

Chapter 90I

Complete Streets Program

Section 1. As used in this chapter, the following words, unless the context clearly requires otherwise, shall have the following meanings:-

“Complete streets”, shall mean streets that provide accommodations for users of all transportation modes including, but not limited to, walking, cycling, public transportation, automobiles and freight.

“Department”, shall mean the Massachusetts Department of Transportation.

“Program”, shall mean the complete streets program under this chapter.

Section 2. There shall be within the department a complete streets grant program to encourage municipalities to regularly and routinely include complete streets design elements and infrastructure on new, reconstruction, and maintenance projects on locally-funded roads.

Section 3. In order to be designated as eligible to receive grant funding pursuant to the program, a municipality shall: (a) apply with the department in a form and manner prescribed by the department; (b) adopt a complete streets by-law, ordinance or administrative policy in a manner which shall be approved by the department and which shall include at least 1 public hearing; provided, however, that the by-law, ordinance or administrative policy shall identify the body, individual or entity responsible for carrying out the complete streets program (c) ensure that a municipal employee participates in a department training for the program; (d) develop a complete streets prioritization plan; and (e) comply with other requirements of the department.

Section 4. The department may adopt rules, regulations and guidelines for the administration of this chapter including, but not limited to, criteria for awarding grants under the program, application procedures, and other requirements. The department shall consult with the Massachusetts bicycle and pedestrian advisory board established in section 11A of chapter 21 of the Massachusetts General Laws and the healthy transportation compact established in section 33 of chapter 6C of the Massachusetts General Laws on the development and management of the program.”

MassDOT Employees Clarification

Mr. McGee moved that the proposed new text be amended by inserting after section ___, the following new section:-

“SECTION ____. Notwithstanding the provisions of any general or special law to the contrary, the personnel administrator shall certify any active employee who was transferred pursuant to chapter 25 of the acts of 2009 to, hired after November 1, 2009 into, or is serving provisionally or by emergency appointment in, any labor service position in the Massachusetts Department of Transportation on April 30, 2016 to permanent civil service status in that position; provided, however, that any such employee not serving in the position for at least six months immediately prior to April 30, 2016, shall serve a probationary period as provided by section 34 of chapter 31 of the General Laws. The civil service seniority date for employees certified as provided herein shall be the first date of service in the position but not before November 1, 2009. The civil service seniority date of any person who held permanent civil service status in a labor service position at the former Massachusetts Highway Department or the department of conservation and Recreation immediately prior to November 1, 2009 and was transferred to the Massachusetts Department of Transportation shall not be affected.;”

MBTA Capacity and State of Good Repair Reporting

Messrs. McGee, Timilty and Keenan, Ms. Forry and Mr. Eldridge moved that the proposed new text be amended by inserting after section ___, the following new section:-

“SECTION _____. (a) The secretary of transportation shall prepare a report that includes an analysis and assessment of current capacity constraints, safety conditions and the state of good repair of the commonwealth’s transportation system, including all modes of surface transportation. The assessment shall analyze the current planned operating and capital expenditures of the department, including the Massachusetts Bay Transportation Authority and the regional transit authorities, and shall consider and state the baseline of the surface transportation revenues currently available and projected to be available from all sources in all modes of surface transportation, regardless of the fund in which they are kept, from fiscal year 2017 through fiscal year 2028. The baseline assessment shall: (i) project spending for the maintenance of the existing system, the completion of all expansion projects the commonwealth is legally bound to complete and capital improvements and projects included in the fiscally-constrained, long-range transportation plans mandated by federal law; (ii) consider and incorporate any additional expenditures necessary to implement the most recent capital plans of the Massachusetts Bay Transportation Authority and the Massachusetts Department of Transportation. The report shall recommend specific and quantified potential new revenue sources pertaining to both operating and capital funds in fiscal year 2017 through fiscal year 2028, in order to fully address any deficiencies in capacity, safety or state of good repair identified in its assessment; provided, that the report’s revenue recommendations shall consider the needs of both the Massachusetts Bay Transportation Authority and the statewide transportation system and provided further that said report may include recommendations beyond own-source revenues and shall remain consistent with the Massachusetts Bay Transportation Authority fare policy set forth in section 61 of chapter 46 of the acts of 2013.

 

(b) The secretary shall provide status updates of department and authority actions relative to the items identified in this section with the joint committee on transportation not later than August 15, 2016 and October 15, 2016 and shall file its final report with the clerks of the house of representatives and the senate, the joint committee on transportation and the house and senate committees on ways and means not later than December 15, 2016. Thereafter, the Massachusetts Bay Transportation Authority Fiscal and Management Control Board, established in section 80A,

Bonding Authority for the Metropolitan Highway Tolls

“SECTION _____.Chapter 6C, Section 13, of the General Laws is hereby amended by striking out subsection (c) and inserting in place thereof the following two subsections:

(c) All revenue received from tolls, rates, fees, rentals and other charges for transit over or through all tolled roads, bridges or tunnels outside of the Metropolitan Highway System shall be applied exclusively to: (i) the payment of existing debt service on such tolled roads; and (ii) the cost of owning, maintaining, repairing, reconstructing, improving, rehabilitating, policing, using, administering, controlling and operating such tolled road.

(d) All revenue received from tolls, rates, fees, rentals and other charges for transit over or through all tolled roads, bridges or tunnels within the Metropolitan Highway System shall be applied exclusively to: (i) the payment of new and existing debt service on such tolled roads; and (ii) the cost of owning, maintaining, repairing, reconstructing, improving, rehabilitating, policing, using, administering, controlling and operating such tolled road.”

“In order to ensure the timely and consistent payment for police details assigned to public works projects performed under this chapter, the project awarding authority shall assume direct responsibility for maintaining police detail records, receiving invoices from, and making direct payments to those entities providing such paid details. The cost of police details shall not be included as part of the bid submitted by any offerer responding to a bid solicitation conducted in accordance with this chapter.  This paragraph shall be referenced or included as part of the bid documents for public works projects.”

Springfield to Boston High-speed Rail Feasibility Study

“SECTION 77A. Notwithstanding any general or special law to the contrary, the Massachusetts Department of Transportation shall conduct a feasibility study relative to high-speed rail access between the cities of Springfield and Boston.

The study shall examine and evaluate the costs and economic opportunities related to establishing high-speed rail service between the cities of Springfield and Boston including, but not limited to: (i) the projected capital costs; (ii) the projected operating costs and revenue estimates; (iii) the projected ridership levels; (iv) the prospect of operating high-speed rail service on existing rights of way and other operational issues, including upgrades to the at-grade crossings in the towns of Ashland and Framingham; (v) the environmental and community impact estimates; (vi) the availability of federal, state, local and private sector funding sources; and (vii) the resulting economic, social and cultural benefits to the greater Springfield region and the commonwealth as a whole.

The department shall file the report with the clerks of the house and senate, the chairs of the house and senate committees on ways and means and the senate and house chairs of the joint committee on transportation not later than March 1, 2017.”

Clarifying the Limit on MBTA Fare Increases

"SECTION 53A.  Section 61 of chapter 46 of the acts of 2013 is hereby amended by striking out subsection (d) and inserting in place thereof the following subsection:-

(d) Fares shall not be increased more than once in a 24-month period.  No fare shall be increased greater than 5 per cent during said 24-month period.  Fare or fares shall be any amount paid by a user including, but not limited to, the cost of any single-ride price for a mode, the cost of a pass, and any discount from the cost of a single-ride price or the cost of pass, regardless of fare payment type, product, or media.; and

by inserting, after section 80, the following new section:-

SECTION 80A.  Section 53A shall take effect on January 1, 2017."

Water Transportation Advisory Council

Mr. McGee, Ms. Forry, Messrs. Keenan and Montigny and Ms. Lovely moved that the proposed new text be amended by inserting after section ___, the following new section:-

“SECTION ___. There shall be a water transportation advisory council which shall be charged with creating a vision for a comprehensive system of water transportation services serving the Commonwealth’s ferry passengers, including commuters and tourists, in a safe, secure, environmentally sustainable, and efficient manner. The council shall consist of, but not be limited to, the secretary of transportation who shall serve as as the chair, the general manager of the Massachusetts Bay Transportation Authority, the chairs of the Joint Committee on Transportation, the chief executive officer of Boston Harbor Now, the president of the Boston Harbor Island Alliance, the executive director of the Seaport Economic Council, the general manager of the Woods Hole, Martha’s Vineyard, and Nantucket Steamship Authority, the chief executive officer of Massachusetts Port Authority, representatives from the private ferry operations industry, the  mayor of the City of Boston, the mayor of the City of Lynn, the mayor of the City of New Bedford, the mayor if the City of Salem, the manager of the Town of Hull, the manager of the Town of Winthrop, the manager of the Town of Provincetown, the manager of  the Town of Hingham, and the mayor of the City of Quincy. Membership shall be expanded as considered appropriate upon consensus by the aforementioned.

The council shall: (i) identify an overall vision for the ferry system in the Commonwealth to enable the transportation of people, goods and vehicles by water; (ii) develop a series of goals and objectives to support this overall vision; (iii) identify implementable policies and improvements, including, but not limited to, investment of public funds to support operating and capital expenses for existing and new ferry services throughout the Commonwealth; and (iv) support the state agencies and independent authorities responsible for planning, designing, constructing, operating, funding and maintaining the ferry transportation infrastructure facilities in the Commonwealth.

The council shall prepare and make available to the public a report summarizing its work not less than every six months.

The council shall be administratively supported by the Massachusetts Department of Transportation. The council shall conduct its first meeting not more than 90 days after the effective date of the act, and shall conduct meetings not less than quarterly thereafter.

MassDOT Fix It First

"SECTION__.  Notwithstanding any general or special law to the contrary, the secretary of transportation shall issue a 5 year plan, as provided for in section 11 of chapter 6C, no later than 180 days after the passage of this act.  Said plan shall prioritize projects to provide for the reduction in the number of structurally deficient bridges, to reduce congestion attributable to disrepair, to improve urban and rural primary pavement conditions, to improve interstate pavement conditions, to increase maintenance disbursements per mile to the level necessary to achieve and maintain a state of good repair, to return bus and transit assets into a state of good repair, to improve track and signalization conditions, or to otherwise eliminate the backlog on transit, road, and bridge projects.  The plan shall not include any capital expansion projects.  The plan shall be published as provided for in section 11 of chapter 6C."

Enhancing the license plate system of the Commonwealth

Messrs. Tarr, O'Connor and Fattman and Ms. Lovely moved that the proposed new text be amended by inserting, after section ___, the following new sections:-

SECTION_.SECTION 1. The registrar is hereby authorized and directed, pursuant to the authority granted by section 2 of chapter 90 of the General Laws, to develop, design and implement a redesigned plate system for motor vehicles registered in the Commonwealth, provided further that such system shall be fully implemented not later than five years following the passage of this act.  Said plate shall incorporate technology and design components and advances to increase the illumination and visual recognition of said plates.  Said plates shall incorporate, but shall not be limited to, the following:

The utilization of commonly recognizable symbols, which are easily identifiable, with each symbol having a corresponding three character alpha-numeric reference, with no more than two characters identifying the symbol, and one character representing the location of the symbol on the plate, such that both the symbol and the references may be placed in a variety of locations on the plate, so as to the maximize the number of individual combinations which may be produced in conjunction with standard letters and numbers.

The utilization of existing and innovative technologies and componentry to aid in the identification of characters in conditions that result in poor-visibility, including during nighttime and inclement weather.

The reduction of the number of standard alpha-numeric characters currently utilized for such plates to no more than a total of four.

The utilization of specialized symbols either supplied by the registrar or developed by private charitable interests and approved by the registrar pursuant to the requirements of this act, provided that the use such symbol shall be conditioned on the payment of a fee in addition to that required for a vehicle registration pursuant to section 2 of chapter 90.

The accommodation of all currently issued distinctive and low-number plates, so-called, including plates authorized under sections 2 and 2E of chapter 90, as well as any additional distinctive license plates issued by the registrar pursuant to the requirements of section 2F of chapter 90.

There shall be hereby created and established a registration plate design and implementation board, hereinafter the board. The board shall consist of eight members, the Registrar of motor vehicles or his designee, who also shall be the chair, the Secretary of the Executive Office of Public Safety or his designee, the Colonel of the Department of State Police or his designee, the Executive Director of the Criminal System Histories Board or his designee, the Executive Director of the Municipal Police Training Committee or his designee, a representative of the Governor’s Highway Safety Bureau, a representative of the Massachusetts Chiefs of Police Association, and a representative of the Massachusetts Safety Officers Association.   The board shall approve a design and establish protocols for the implementation of a redesigned plate system that provides for additional public safety through the simplification of plate design for the purposes of enhancing the recognition, recall and identification of plates.  In addition, the board shall develop training protocols for utilization of the redesigned plate for public safety officers.  The board shall report to the Joint Committee on Public Safety and Homeland Security regarding any issues relating the design or implementation of said plate system not later than six months of the passage of this act.

The registrar may, in carrying out the provisions of this Act, enter into one or more contracts for the design, development, implementation, maintenance or production of said plate system.

SECTION 2.  There shall be hereby established and set up on the books of the Commonwealth a special fund to be known as the License Plate Symbol Revenue Fund, hereinafter called the fund, into which shall be deposited any funds granted by the issuance of specialized symbols created to the provisions of item 4, in section 1 of this act.  The primary purpose of the fund shall be to make expenditures in order to facilitate the implementation of the license plate program developed pursuant to this act, and the secondary purpose of the fund shall be to distribute funds to specific charitable programs or purposes as specified for specialized symbols as authorized pursuant to the provisions of item 4 of section 1 of this act.

SECTION 3.  In carrying out the provisions of this Act, the registrar shall consult with the American Association of Motor Vehicle Administrators and any other necessary agencies of the federal government, national or regional organizations, and any necessary state agencies to determine the feasibility, including costs and advantages and disadvantages, of developing and implementing the plate system prescribed by section 1 of this act.  The registrar shall report the findings of said feasibility analysis to the Clerks of the House and Senate, the Joint Committee on Transportation and the Joint Committee on Homeland Security and Public Safety not later than six months following the passage of this Act.

SECTION 4.  Sections 1 and 2 of this act shall take effect ninety days following the filing of the feasibility analysis by the registrar as provided in section 3.

Mr. Timilty moved that the proposed new text be amended by adding at the end thereof the following new section:-

SECTION X. No funds shall be disbursed to the Massachusetts Bay Transportation Authority under section 35T of chapter 10 of the General Laws for the extension of services on the Framingham Secondary line in the towns of Framingham, Sherborn, Medfield, Walpole, Foxborough, and Mansfield including, but not limited to, for the addition of new line service through the creation of a new line, extension of a current line or increasing the service area of a current line until the authority receives legislative approval for a plan, specifically detailing:

(i) how the authority will pay for the proposed expansion

(ii) certification that such expansion and diversion of funding will not adversely affect existing services already offered by the authority and

(iii) certification that the state of the Framingham Secondary line’s real property, including but not limited to the physical track, at-grade crossings, and safety features to protect abutters, have been upgraded, repaired, or replaced to meet any increase in service

The plan shall be submitted to the clerks of the senate and house of representatives, the joint committee on transportation and the chairs of the senate and house committees on ways and means.

MBTA Retirement Fund Study

The Secretary of Administration and Finance is directed to study the operation and performance of the MBTA Retirement Fund, using actuarial methods, comparing the performance of the MBTA Retirement Fund to other American retirement and pension funds, making note of such other oversight issues as may arise during the study. The study is to be completed and submitted to the Speaker of the House and the Senate President; the House and Senate Committees on Ways and Means; the MBTA Board of Directors and the MBTA Advisory Board on or before January 1, 2017.

Reducing Non-Revenue Toll Transponder Usage

Interchange Study

Messrs. Humason and Lesser moved that the proposed new text be amended by inserting after section 77 the following section: -

"SECTION 77A. (a) The Massachusetts Department of Transportation shall conduct a feasibility study relative to the establishment of an interchange on interstate highway route 90 between the existing interchanges located in the city of Westfield and the town of Lee.  The study shall examine and evaluate the costs and economic opportunities related to establishing the interchange  between the city of Westfield and the town of Lee including, but not limited to: (i) the projected capital costs; (ii) the projected operating costs; (iii) the projected use levels; (iv) the environmental and community impact estimates; (v) the availability of federal, state, local and private sector funding sources; and (vi) the resulting economic, social and cultural benefits to the surrounding region and the commonwealth.

(b) The department shall file a report of the results of its study with the clerks of the senate and house of representatives, the chairs of the senate and house committees on ways and means and the senate and house chairs of the joint committee on transportation not later than July 1, 2017."

Collected Toll Use Clarification

Messrs. Humason, Welch and Fattman, Ms. Gobi, Messrs. O'Connor, Lesser, Tarr and Ross moved that the proposed new text be amended by inserting, after section XX, the following new section: -

"Section XXXX. Notwithstanding any general or special law to the contrary, if all notes and bonds issued by the department relating to the turnpike, as defined in section 1 of chapter 6C of the General Laws, and payable from turnpike revenues have been paid and all obligations pursuant to all trust agreements pertaining to such notes and bonds have been discharged, all revenue received from tolls, rates, fees, rentals and other charges for transit over or through all turnpike tolled roads, bridges or tunnels shall be applied, first, to the cost of owning, maintaining, repairing, reconstructing, improving, rehabilitating, policing, using, administering, controlling and operating such turnpike, and otherwise, to the cost of owning, maintaining, repairing, reconstructing, improving, rehabilitating, policing, using, administering, controlling and operating those portions of the state highway system outside the perimeter bounded by Route 128 that provide necessary access to such turnpike."

“Section _.  Chapter 66 is hereby further amended by inserting, after section 17D, the following section:-

Section 17E.  A document made or received by the Massachusetts Bay Transportation Authority Retirement Board or any other legal entity, public or private, which receives funds from the Massachusetts Bay Transportation Authority for the payment or administration of pensions for any employee of the Massachusetts Bay Transportation Authority shall be considered a public record under clause Twenty-sixth of section 7 of chapter 4 and this chapter.”; and

Moves to further amend by inserting after section __ the following section:-

“SECTION _.  Section 17E of chapter 66 of the General Laws shall apply to any document made or received by the Massachusetts Bay Transportation Authority Retirement Board or any other legal entity, public or private, which receives funds from the Massachusetts Bay Transportation Authority for the payment or administration of pensions for any employee of the Massachusetts Bay Transportation Authority on or after the effective date of this act.”
