Promoting local economic development
Mr. Lewis moved that the proposed new text be amended by inserting, after section X, the following new section:-
"section X. Chapter 23A of the General Laws is hereby amended by adding after section 64 the following section:-
Section 65. (a) The executive office of housing and economic development shall establish a local economic development assistance program. The purpose of the program shall be to provide technical assistance and financial assistance, in the form of grants, to cities and towns.
(b) To participate in the local economic development assistance program, a city or town, or two or more cities or towns applying jointly, shall: (1) file an application for technical assistance with the executive office of housing and economic development in a form and manner to be prescribed by the office; and (2) complete an economic self-assessment identifying opportunities for growth. Following completion of the economic self-assessment, the city or town, or two or more cities or towns applying jointly, shall be deemed eligible to apply for financial assistance.
(c) An eligible city or town, acting by and through its municipal officers or by and through any agency designated by such municipal officers to act on their behalf, may apply to the program for a grant in a specific amount to fund a development initiative identified as an opportunity for growth in the economic self-assessment. Two or more municipalities may apply jointly, with 1 municipality acting as fiscal agent, or through a regional planning agency acting as fiscal agent. The grants may be made in addition to other forms of local, state, and federal assistance.
(d) Funding for the local economic development assistance program in any single fiscal year shall be available subject to appropriation in a total amount of not more than $10 million, or through other funds as the governing board of the Massachusetts Development Finance Authority shall provide.
(e) The office shall adopt rules, regulations, and guidelines for the administration and enforcement of this section, including, but not limited to, establishing applicant criteria, application forms and procedures, and reporting requirements.
(f) The office shall annually, no later than April 1, submit a report to the clerks of the senate and house of representatives, the joint committee on economic development and emerging technologies, the joint committee on state administration and regulatory oversight, and the senate and house committees on ways and means detailing the expenditures and results relative to the local economic development assistance program."

Section 108K. No company, and no officer or agent thereof, shall make or permit any distinction, classification, discrimination, or otherwise recognize any difference, on the basis of race, color, religion, sex, marital status, or national origin, in the amount or payment of premiums or rate charges, or in the benefits payable, or in any of the other terms or conditions of any group or individual disability, accident or sickness insurance contract issued or delivered within or without the commonwealth on or after January 1, 2011 which covers one or more residents of the commonwealth. As used in this section, sex includes, but is not limited to, conditions unique to one sex, such as pregnancy. Any violation of this section shall constitute an unfair method of competition or an unfair or deceptive act or practice in violation of chapter 176D.”

Lewis and Brownsberger moved that the proposed new text be amended in section 2, in item 7004-0101, in line 84, after the word "assistance;" by striking out words "and (6) exits to any other subsidized housing program" and inserting in place thereof the following text and inserting the following text:- (6) exits to any other subsidized housing program (7) the number of families who inquired about applying for shelter or HomeBASE but for whom an application was not taken and the reasons why applications were not taken; and (8) the number of applications that were denied and the reasons for such denials"; and in said line item by adding at the end thereof the following:- "provided further, that the department shall report quarterly to the house and senate committees on ways and means detailing the number of families transitioned from shelter benefits to affordable, subsidized or otherwise assisted housing through this program; provided further, that the report shall include the average, minimum and maximum cost per family of such assistance, the number of families served who required further assistance at a later date, the type of assistance later required and provided and the current housing stability of each family who received transitional housing or short-term housing assistance within the prior 12 months; provided further, that the report shall also include the following information from the department of children and families: (a) the number of families assessed for shelter eligibility based on a substantial health or safety risk in the previous quarter; (b) the number of families determined to be at a substantial health and safety risk; (c) the number of families receiving multiple health and safety assessments within the previous 6-month period; and (d) the standards used to determine a substantial health and safety risk; provided further, the report shall include the following demographic information regarding households being served in the shelter system: 1) the ages of the heads of household 2) the race and ethnicity of heads of households 3) the number of children served in the shelter system during the quarter broken down by age; 4) the average income and breakdown of income type of families served by the shelter system; 5) breakdown of educational attainment of the heads of household.

Encouraging Cultural Council Funding
Messrs. Tarr, O'Connor, Fattman, Lesser and Ross moved that the proposed new text be amended by inserting after section __ the following new sections:-
“SECTION __. Chapter 10 of the General Laws is hereby amended by inserting after section 57 the following two sections:-
Section 57½. The council shall stimulate and encourage the arts, humanities and interpretive sciences within cities and towns by administering the distribution of the Massachusetts Cultural Development Fund established pursuant to section 57¾ to cities and towns on a county basis as hereinafter provided.
The council shall receive applications for said funds from cities and towns and shall annually distribute funds received in the proceeding taxable year from any source so that those funds are distributed to cities and towns within a county in proportion to the amount contributed to the Massachusetts Cultural Development Fund in the preceding taxable year by taxpayers within each county, pursuant to section 6O of chapter 62.
The council shall publish and make available on its website, at least annually, (i) the total amount contributed pursuant to said section 6O, (ii) the subtotal amounts contributed by each county, (iii) the subtotal amount contributed by taxpayers with addresses outside of the commonwealth, (iv) the subtotal amount credited or transferred to the fund from any other fund or source; and (v) the per county percentage to be applied for the distribution of funds under this section.
Section 57¾. There shall be established and set up on the books of the commonwealth a separate fund, to be known as the Massachusetts Cultural Development Fund. The fund shall consist of all revenues received by the commonwealth pursuant to section 6O of chapter 62 and all other monies credited or transferred thereto from any other fund or source pursuant to law.
All revenues credited under this section shall remain in the Massachusetts Cultural Development Fund, not subject to appropriation, to assist the council in its promotion and encouragement of the arts. The state treasurer shall not deposit said revenues in or transfer said revenues to the General Fund or any other fund other than the Massachusetts Cultural Development Fund.
The state treasurer shall deposit the revenues in the fund in accordance with the provisions of section 34 of chapter 29 in such manner as will secure the highest interest rate available consistent with the safety of the fund and with the requirement that all amounts on deposit be available for immediate withdrawal at any time. The fund shall be expended only for the purposes stated above at the direction of the council and any unexpended balances shall be redeposited, as herein provided, for future use consistent with this section.
SECTION __. Chapter 62 of the General Laws is hereby amended by inserting after section 6N the following section:-
Section 6O. Every individual who files a separate return and every spousal couple filing a return jointly may voluntarily contribute all or part of any refund to which they are entitled or may voluntarily add an amount onto any amount due to be credited to the Massachusetts Cultural Development Fund, established pursuant to section 57¾ of chapter 10.
A contribution made under this section may be made with respect to any taxable year at the time of filing a return of the tax imposed by this chapter for such taxable year. The commissioner shall prescribe the manner in which such contribution shall be made on the face of the return required by section 5 of chapter 62C; provided, however, that the commissioner shall assure that taxpayers filing any such forms are made clearly aware of their ability to make the contributions provided for by this section.
The commissioner shall annually certify to the state treasurer and the Massachusetts Cultural Council, established pursuant to section 52 of chapter 10, the total amount contributed under this section and the treasurer shall credit such total amount to the Massachusetts Cultural Development Fund. The commissioner shall report to the Massachusetts Cultural Council the percentage of contribution amounts by county as determined by the address of the taxpayer. Contributions made by taxpayers with addresses outside of the commonwealth shall be aggregated and reported as a separate category.”

“7004-9030 For the rental assistance program established in section 16 of chapter 179 of the acts of 1995; provided, that notwithstanding any general or special law to the contrary, the rental assistance program shall be in the form of mobile vouchers and project based vouchers; provided further, that the vouchers shall be in varying dollar amounts set by the department of housing and community development based on considerations including, but not limited to, household size, composition, household income and geographic location; provided further, that any household that is proven to have caused intentional damage to its rental unit in an amount exceeding 2 months rent during any 1-year period shall be terminated from the program; provided further, that notwithstanding any general or special law to the contrary, there shall be no maximum percentage applicable to the amount of income paid for rent by each household holding a mobile voucher; provided further, that each household shall be required to pay not less than 25 per cent of its net income as defined in regulations promulgated by the department for units if payment of utilities is not provided by the unit owner or not less than 30 per cent of its income for units if payment of utilities is provided by the unit owner; provided further, that payments for the rental assistance program may be provided in advance; provided further, that the department shall establish the amounts of the mobile vouchers so that the appropriation in this item is not exceeded by payments for rental assistance and administration; provided further, that the department shall not enter into commitments which shall cause it to exceed the appropriation set forth in this item; provided further, that the amount of a rental assistance voucher payment for an eligible household shall not exceed the rent less the household’s minimum rent obligation; and provided further, that the word “rent”, as used in this item, shall mean payments to the landlord or owner of a dwelling unit under a lease or other agreement for a tenant's occupancy of the dwelling unit, but shall not include payments made by the tenant separately for the cost of heat, cooking fuel or electricity………………………………………………………$7,100,000

“SECTION ___. Notwithstanding any general or special law to the contrary, including section 14 of chapter 34 of the General Laws, but subject to subsections (a), (b) and (g) of section 16 of chapter 30B of the General Laws, the county commissioners of the county of Dukes County may lease space in a building acquired by the county pursuant to section 112 of chapter 287 of the Acts of 2014, to the Martha’s Vineyard Center for Living, Inc., a non-profit corporation, or its designee or affiliate, for an initial term not to exceed 30 years, for the purpose of the Martha’s Vineyard Center for Living, Inc. conducting health and social services for the benefit of residents of the county or visitors thereto, including but not limited to a Supportive Day Program, so called, for seniors, a medical taxi program for seniors, food and meals programs for seniors, and outreach and referral programs for seniors. The lease may provide that the Martha’s Vineyard Center for Living, Inc. may, on terms acceptable to the county commissioners, design, construct or build-out the leased premises. The lease shall provide that the costs of the improvements to the leased premises by the Martha’s Vineyard Center for Living, Inc. shall be taken into account as part of the consideration for such lease. The lease shall include provisions to ensure community accessibility, in a manner consistent with the corporate and charitable purposes of the Martha’s Vineyard Center for Living, Inc.
If the premises leased during the term of the lease authorized in section 1 are ever used for any purpose other than the purposes listed in section 1 or as listed in the terms of the lease that is ultimately negotiated by the county commissioners of Dukes County, then the authorization to lease space in the building to the Martha’s Vineyard Center for Living, Inc. granted by this act shall immediately become null and void.
Notwithstanding any general or special law to the contrary, the design and construction of any such improvements shall be exempt from sections 44 to 58, inclusive, of chapter 7C of the General Laws, section 39M of chapter 30 of the General Laws, sections 44A to 44M, inclusive, of chapter 149 of the General Laws, and chapter 149A of the General Laws; provided, however that any construction or improvements by the Martha’s Vineyard Center for Living, Inc., or its designee or affiliate, to the space in the building acquired by the county pursuant to section 112 of chapter 287 of the Acts of 2014 shall be subject to sections 26 to 27H, inclusive of said chapter 149."

“SECTION ____. Section 87T of chapter 112 of the General Laws, as appearing in the 2014 Official Edition, is hereby amended by inserting, in line 76, before the definition of “Post-secondary institution” the following two definitions:-
“Mobile business” a person or organization authorized by the board to provide mobile services.
“Mobile Services” those practices within the definitions of aesthetics, barbering, cosmetology, electrolysis, hairdressing, and manicuring that the board authorizes to be provided at locations other than a licensed shop.
SECTION ____. The first paragraph of Section 87V of said chapter 112, as so appearing, is hereby amended by inserting, in line 4, after the word “manicuring”, the words “mobile services,”.
SECTION ____. The first paragraph of said Section 87V of said chapter 112, as so appearing, is hereby further amended by inserting, in line 4, after the word “shops”, the words “and mobile businesses”.

SECTION ____. Section 87AA of said chapter 112, as appearing, is hereby amended by striking out the first paragraph and inserting in place thereof the following paragraph:-
Section 87AA. The board may authorize 1 or more licensees or any person employing 1 or more licensees, upon payment to the board of a fee as provided in section 87CC, to operate a licensed shop. A mobile business or the holder of a shop license shall not employ for hire or allow any individual to provide aesthetics, barbering, cosmetology, electrolysis, hairdressing or manicuring in such shop or mobile business unless the individual is licensed in accordance with sections 87T to 87JJ, inclusive.
SECTION ____. Section 87AA of said chapter 112, as so appearing, is hereby further amended by striking out the second paragraph and inserting in place thereof the following paragraph:-
Shop licenses issued under this section shall be valid only for the location named therein. Upon change of location of a licensed shop, a new license shall be issued to such shop upon payment of the fee provided in section 87CC. Shop licenses and mobile business authorizations shall not be transferable.
SECTION ____. Section 87CC of chapter 112, as so appearing and as amended by St. 2016, c. 70, § 5, is hereby further amended by inserting after the last sentence the following sentence:-
All licensing and application fees and civil administrative penalties collected under sections 87T to 87JJ, inclusive, shall be deposited into the Division of Professional Licensure Trust Fund established in section 35V of chapter 10.
SECTION ____. Said chapter 112 of the General Laws, as appearing in the 2014 Official Edition, is hereby further amended by striking out section 87DD and inserting in place thereof the following section:-
Section 87DD. The board may enter and inspect any shop, school or mobile business in a proper manner at any time during business hours thereof. Whenever a complaint is made to the board that any person has suffered personal injury as a result of the practice of the occupation of aesthetics, barbering, cosmetology, electrology, hairdressing or manicuring or that any person has been exposed to a hazard to the public’s health, safety or welfare or that any contagious or infectious disease has been imparted, at any shop or by any licensee or authorized mobile business, or that any shop, school or location where mobile services are performed is kept in an unsanitary condition or that any person has been engaged in aesthetics, barbering, cosmetology, electrolysis, hairdressing or manicuring in violation of sections 87T to 87JJ, inclusive, the board shall visit and inspect such school or place where such violation is alleged to have occurred and enforce said sections 87T to 87JJ inclusive in accordance with applicable law and regulations. The board may investigate the standard of professional training at any school and the sufficiency of the course or courses there given.
SECTION ____. Section 87II of said chapter 112, as so appearing, is hereby amended by striking out the first paragraph and inserting in place thereof the following paragraph:-

SECTION XX. Subsection (a) of section 6I of chapter 62 of the General Laws, as appearing in the 2014 Official Edition, is hereby amended by inserting the following definitions:-
“Qualified Donation" real or personal property donated to a sponsor for the use of purchasing, constructing, or rehabilitating a qualified Massachusetts project.
“Sponsor” a not-for-profit organization which (1) has been issued a ruling from the Internal Revenue Service of the United States Department of the Treasury that the organization is exempt from income taxation under section 501(c)(3) of the Code; (2) will have material control over the operations of a qualified Massachusetts project; and (3) either (i) is a certified Community Development Corporation, as defined in chapter 40H; (ii) is a certified Community Housing Development Organization under section 92.2 of title 24 of the Code of Federal Regulations; or (iii) is determined by the department to have a track record of successful development of affordable housing projects in Massachusetts.
SECTION XX. Subsection (b) of said section 6I of said chapter 62, as so appearing, is hereby amended by inserting the following:-
(4) The department may authorize and allocate Massachusetts low-income housing tax credits under this section for a qualified donation by a taxpayer. The total Massachusetts low-income housing tax credit available to a taxpayer for a qualified donation shall be equal to 50 per cent of the donation’s value, as determined by the department, provided, however, that the department shall be authorized to increase the amount of available credit for a qualified donation to up to 65 per cent of the donation’s value if it deems such an increase necessary to the project’s viability.
SECTION XX. Paragraph (1) of subsection (c) of said section 6I of said chapter 62, as so appearing, is hereby amended by inserting after the word “project”, in line 81, the following:- , whether by qualified donation or otherwise.
SECTION XX. Said subsection (c) of said section 6I of said chapter 62, as so appearing, is hereby amended by striking out paragraph (3) and inserting in place thereof the following:-
(3) The Massachusetts low-income housing tax credit authorized to a taxpayer with respect to a qualified Massachusetts project other than a qualified donation shall be taken against the taxes imposed under this chapter, claimed equally for 5 years and subtracted from the amount of state tax otherwise due for each taxable period, and shall not be refundable. The Massachusetts low-income housing tax credit authorized to a taxpayer with respect to a qualified Massachusetts project attributable to a qualified donation shall be taken against the taxes imposed under this chapter, claimed in a single year and subtracted from the amount of state tax otherwise due for the taxable year, and shall not be refundable. Any amount of the low-income housing tax credit that exceeds the tax due for a taxable year may be carried forward to any of the 5 subsequent taxable years.
SECTION XX. Subsection (a) of section 31H of chapter 63 of the General Laws, as so appearing, is hereby amended by inserting the following definitions:-

Section 6. (a) For the purposes of this section, the following words shall have the following meanings unless the context clearly requires otherwise:
“Agency”, an agency for the issuance of bonds as determined by the secretary of administration and finance.
“Annual cash flow”, for a WHPP project, the amount of surplus cash remaining after all project operating costs have been paid, including interest and principal on any indebtedness, reserves for replacement, reserves for operations and the payment of the priority return, and after any payments required to be paid to the equity partner for federal historic tax credits, or FHTC, plus any reserves reasonably set aside to make anticipated exit payments after 5 years to the FHTC investors; provided, however, that the reserves for operations shall be as determined by the department and shall be calculated to retain in the project sufficient reserves to fund the payment of all accounts payable, accrued expenses, and the interest payments due for the subsequent month.
“Bonds”, when used in reference to an agency or other entity for the sale of Bonds, be any bonds, notes, debentures, interim certificates or other financial undertakings for the purpose of raising capital including, but not limited to, lines of credit, forward purchase agreements, investment agreements and other banking or financial arrangements issued or entered into by the agency.
“Eligible communities”, communities that are gateway city communities or smaller communities which have an industrial heritage, blight and deterioration in the designated areas, and a supply of historic buildings; provided, however, that HDIP districts for WHPP developments may be located in non-gateway city communities pursuant to regulations to be issued by DHCD.
“Eligible districts”, the areas comprising an approved HDIP district.
“Housing development tax credit”, a tax credit which a taxpayer is eligible to utilize deriving from the HDIP program.
“Priority return”, a cumulative amount equal to 8 per cent per year times the amount of any permanent cash equity investment made by the owners, members or partners of the ownership entity which shall be paid after the payment of the operating expenses for the project.
“Profits on sale or refinancing”, the amounts remaining upon a sale or refinancing after the repayment of existing indebtedness, payment of the costs of sale or refinancing, the repayment, if any, of any net cash equity investment on which the priority returns are paid, payment of any unpaid cumulative priority returns and other obligations of the ownership entity.
“Program costs”, the total amount of Massachusetts historic rehabilitation tax credits and housing development tax credits that the commonwealth allows with regard to WHPP projects approved by the department.
“Ready to commence construction”, for WHPP projects, the time when the project has received commitments for all financing required to commence construction, including a total allocation of Massachusetts historic rehabilitation tax credits equal to at least $300,000, and all local, state and federal permits necessary for a construction start are issued or are ready to be issued.
“WHPP project”, a real estate development project utilizing the components of the WHPP program which, at the option of the owner, is the subject of an application to the department for housing development tax credits in compliance with the requirements of the WHPP program.
(b)There shall be a workforce housing production program, or WHPP. All requirements of the HDIP program shall apply to WHPP projects, except as provided in this section. The WHPP program shall be available in all gateway cities and other eligible communities in which HDIP districts have been created and approved by the department. An HDIP district may be approved by the department to support WHPP developments in eligible communities that are not gateway cities. Such communities shall have:
(i) an industrial heritage;
(ii) an historic building suitable for conversion to market rate housing; and
(iii) blight and deterioration in the designated area.
(c) (1) At the option of the owner or developer of an eligible project in an HDIP district, the housing development tax credits in WHPP districts shall be an amount equal to 25 per cent of the qualified substantial rehabilitation costs. If the housing development tax credit is increased to 25 per cent pursuant at the option of the owner or developer, then the project shall be considered a WHPP project and this section 6 shall apply.
(2) In all WHPP projects, the commonwealth shall be paid a share of the cash flow and a share of the profits from the sale or refinancing of the development equal to 25 per cent. Such participation shall expire upon the sale of the property to a buyer with no affiliation with the initial owner or developer of the project.
(d) If a WHPP project is ready to commence construction but has not received the full allocation of Massachusetts historic rehabilitation tax credits for which the WHPP project is eligible but has received approval as an eligible project and has received an allocation of Massachusetts historic rehabilitation tax credits equal to at least $300,000, then the state secretary shall increase the amount of the allocated Massachusetts historic tax credits for the WHPP project to the full amount for which the project is eligible and such additional allocation shall be outside of and not count against the annual cap on the allocation of Massachusetts historic tax credits.
(e) All WHPP projects shall have prepared and shall submit to the department an audit certified by an independent certified public accountant of project construction and development costs, including rent-up and marketing costs, as of the date of the completion of construction, within 180 days after the completion of construction. Annually thereafter, within 120 days after the end of the project’s fiscal year, a report certified by an independent certified public accountant shall be submitted to the department on the annual financial and occupancy operations in accordance with regulations to be issued by the department.
(f)(1) In WHPP projects there shall be no limit on the per project amount of housing development tax credits that can be allocated and there shall there be no limit on the overall amount of housing development tax credits that may be awarded across the commonwealth except as may be limited by the bonding authority for each fiscal year.
(2) In WHPP districts, the 25 per cent housing development tax credits may be utilized for new construction in accordance with this section.
(3) In WHPP Districts, if rents for which any affordable units are projected to be rented are 90 per cent or more of the actual market rents at which other comparable units in the project are expected to be rented as determined by the department, then the housing development tax credits shall be calculated on the basis of the qualified substantial rehabilitation or construction costs of any such affordable units and on the market units.
(g) In any fiscal year, the secretary of housing and economic development may approve WHPP developments with total program costs equal to the amount of bond authorization for that fiscal year. If projects that are approved in a fiscal year are terminated or do not achieve a start of construction within 18 months after project approval, the secretary may substitute a WHPP project that is ready to commence construction to take up the unutilized bonding authority for the fiscal year of authorization.
SECTION 27B. Paragraph (1) of subsection (q) of section 6 of chapter 62 of the General Laws, as appearing in the 2014 Official Editions, is hereby amended by inserting before the prior second sentence a new second sentence: In the event that the certified housing development project is a workforce housing production project, or WHPP, pursuant to chapter 40V, then the credit to be allowed shall be increased from 10 per cent to 25 per cent.
“SECTION 27C. Said subsection (q) of said section 6 of said chapter 62, as so appearing, is hereby further amended by inserting after paragraph (5) the following paragraph: -
(5½) In the event the certified housing development project is a WHPP project, then paragraph (5) shall not apply and DHCD may authorize an amount of HD credits, which, when combined with the applicable state historic tax credits for the project, equal up to the bonding authorization for the fiscal year of project approval. The approval amounts may include substitute projects that may be approved because of termination or delays experienced by the projects approved in the applicable fiscal year.
SECTION 27D. Subdivision (1) of section 38BB of chapter 63 of the General Laws, as so appearing, is hereby amended by inserting before the prior second sentence a new second sentence: - In the event that the certified housing development project is a workforce housing production project, or WHPP, pursuant to chapter 40V, then the credit to be allowed shall be increased from 10 per cent to 25 per cent.
SECTION 27E. Said section 38BB of said chapter 63, as so appearing, is hereby further amended by inserting after subdivision (5) the following subdivision: -
(5½) In the event the certified housing development project is a WHPP project, then the subdivision 5 shall not apply and DHCD may authorize an amount of HD credits, which, when combined with the applicable state historic tax credits for the project, equal up to the bonding authorization for the fiscal year of project approval. The approval amounts may include substitute WHPP projects that may be approved because of termination or delays experienced by the projects approved in the applicable fiscal year.”; and
by inserting after section 77 the following section: -
“SECTION 77A. The secretary of administration and finance may arrange for the commonwealth or an appropriate agency to sell taxable or tax-exempt general obligation bonds for the WHPP projects pursuant to section 6 of chapter 40V of the General Laws that are approved in fiscal year 2017 in an amount equal to $25,000,000. The bonds shall have such characteristics and terms and shall be in such amounts and at such time as the secretary shall determine.”

Messrs. Tarr, O'Connor and Fattman moved that the proposed new text be amended by inserting after section __ the following new section:-
“SECTION_. Chapter 32, as appearing the 2014 Official Edition is hereby amended by inserting after section 21A the following new section:-
Section 21B. The following definitions shall apply to this section:
“Current employee”, any employee of the Commonwealth or its political subdivisions as of the effective date of this act.
“Post-employment benefits”, any defined benefit to be paid to an employee as a result of their service to the Commonwealth or its political subdivisions in accordance with chapters 32, 32A, 32B or any other general or special law that contains provisions for said benefits.
“Retiree”, any retired former employee of the Commonwealth or its political subdivisions as of the effective date of this act in receipt of post-employment benefits in accordance with chapters 32, 32A, 32B or any other general or special law that contains provisions for said benefits.
“Vested”, any current employee of the Commonwealth or its political subdivisions as of the effective date of this act that is entitled to post-employment benefits at a future date by virtue of and in accordance with the provisions of chapters 32, 32A, 32B or any other general or special law that contains provisions for said benefits.
(a) Notwithstanding any general or special law to the contrary, there shall be established a post-employment benefits Commission that shall perform a comprehensive review and evaluation of the various post-employment benefits provided in the Commonwealth contained in chapters 32, 32A, 32B or any other general or special law that contains provisions for post-employment benefits provided to employees or retirees of any secretariat, board, Commission, authority, municipality, school district or other political subdivision in the Commonwealth. The Commission shall make recommendations to the Governor, House and Senate on improving the efficiency, effectiveness and operations of all existing post-employment benefit systems in the Commonwealth, without exception. The Commission shall focus on changes that should be made to all post-employment benefit systems in the Commonwealth for current and future employees, rather than retirees.
(b) The Commission shall be non-partisan and shall be comprised of the President of the Senate, the Minority Leader of the Senate, the Speaker of the House, the Minority Leader of the House, the Secretary of Administration and Finance, or his designee, the Treasurer and Receiver-General or her designee, the Executive Director of the Massachusetts Municipal Association or their designee, the Executive Director of the Public Employee Retirement Assurance Commission or their designee, the Executive Director of the Group Insurance Commission, or their designee. The Executive Director of the Pension Reserves Investment Management Board, or their designee, The Executive Director of the State Retirement Board, or their designee, the Executive Director of the Massachusetts Teachers’ Retirement System, or their designee and a member of any union with employees that are members of any of the aforementioned Boards or Commissions. There shall be two public members, one who shall be an actuary not currently contracted with any of the aforementioned Boards or Commissions, a certified public accountant who is knowledgeable about Governmental Accounting Standards Board standards related to post-employment benefits and other systems nationwide and not currently contracted with any of the aforementioned Boards or Commissions, both of whom named by the State Comptroller. The Commission shall use the services of the State Comptroller and the Office of the State Comptroller’s general counsel as advisors. The State Comptroller will provide administration and meeting space. At the Commission’s first meeting, which shall take place no more than 15 business days after the effective date of this section, the Commissioners shall elect a chair, a vice chair who shall serve if the chair is absent at a meeting and a secretary who shall be responsible for minutes of the Commission.
(c) The Commission shall be charged with reviewing the current structure of post-employment benefits in the Commonwealth offered to current employees, including, but not limited to, defined benefit pensions, defined benefit healthcare, the administration of all public employee retirement and retiree healthcare systems with a goal of recommending to the Legislature changes necessary to provide for a more efficient, effective and productive system of post-employment benefits. The Commission may consider consolidation of all existing systems into either a single entity or an entity for non-teacher employees and an entity for teachers. Each entity that may be created as a recommendation of the Commission shall be separate irrevocable trusts but using shared actuarial, investment, eligibility determination, receipt, disbursement and administrative functions. Employers that are members of said entity or entities shall proportionately share costs, benefits and any net pension or other post-employment benefit liability in a manner that is actuarially sound. The Commission may consider converting all future employees of public entities in the Commonwealth to a defined contribution plan that would take effect as of a date of the Commission’s recommendation, including a matching contribution by the Commonwealth or a municipality. The Commission may consider changing the structures for current employees who are not vested a of a date of the Commission’s recommendation, including transferring previous contributions to the various systems made by said non-vested employees into defined contribution arrangements. The Commission may also consider an administrative cap on the management of post-employment benefits as a percentage of fiduciary net position of the single entity or the entity for non-teacher employees and for teachers.
(d) The Commission shall meet at least monthly and provide approved minutes to the public within seven business days after approval.
(e) The Commission shall report to the Governor and the Clerks of the House and Senate, no later than December 31, 2015. The report shall consist of an executive summary of the Commission’s work, members, meetings and minutes, an analysis of the current structure of post-employment benefits in the Commonwealth, the structure of post-employment benefits in other States, findings and recommendations and appendices containing draft legislation and any other exhibits that the Commission deems necessary for the Governor and the members of the House and Senate for their knowledge. The Commission then shall work with the members of the House and Senate to pass any recommended legislative changes during the 2016 session. Upon the approval of any General or Special Law related to any of the contents of the Commission’s report, the Commission shall have outreach through the Massachusetts Municipal Association to municipal systems to implement any approved legislation on a timely basis.
(f) Line item 1000-0001 shall be increased by $250,000 each fiscal year for the operations of the Commission while the Commission is empanelled, including the costs of hiring consultants, meeting space in the Office of the State Comptroller, the Office of the State Comptroller’s general counsel and administration of the Commission and shall not revert while the Commission is empanelled.
(g) The Commission shall disband not later than 2 years after the effective date of the approval of any General or Special Law related to any of the contents of the Commission’s report. Any unspent funds as a result of Section 6 of this Act shall revert to the General Fund upon disbanding."

Alternative Housing Voucher Program Reform

SECTION XX. Chapter 179 of the Acts of 1995 is hereby amended by striking out Section 16 in its entirety and inserting in place thereof the following:-
Section 16. The department of housing and community development, hereinafter referred to as DHCD, shall, subject to appropriation, establish and administer a rental assistance program in the form of mobile or project based vouchers for eligible and qualified handicapped persons of low income as determined pursuant to DHCD regulations.
To be eligible for the rental assistance program applicants shall (1) be an eligible and qualified handicapped person of low income in accordance with DHCD regulations; and (2) be eligible and qualified for housing developed pursuant to sections thirty-nine and forty of chapter 121B of the General Laws, or be residing in housing developed pursuant to sections 39 and 40 of said chapter 121B on March 1, 1995.
Income eligibility for the rental assistance program shall be consistent with income eligibility for low rent housing projects developed pursuant to said chapter 121B. Rental assistance program participants shall be required to pay not less than 25 percent of their net income, as defined in DHCD regulations, for units if utilities are not provided by the unit owner, or not less than 30 percent of their income for units if utilities are provided by the unit owner. Rental assistance funds shall be awarded to a local housing agency, either a local housing authority or a regional nonprofit housing agency, on the basis of relative need in the community served by such local housing agency as determined by DHCD.
The local housing agency shall administer the rental assistance program in accordance with regulations established by DHCD. In areas where a local housing authority administers a housing program under the provisions of sections 39 and 40 of said chapter 121B and where the housing authority administers a federal Section 8 existing housing assistance program or Section 8 voucher program and has voted to adopt an amendment to its Section 8 administrative plan, such local housing authority shall receive preference in administering the rental assistance program in accordance with regulations established by DHCD. Such plans shall provide that program participants of the rental assistance program, provided for herein, shall receive first preference consideration coequally with the particular local housing authority's other first preference criteria. In areas where no local housing authority administers a state rental assistance program or does not choose to administer the rental assistance program, regional nonprofit housing agencies shall be eligible to administer the program. As participants either obtain permanent affordable housing or are terminated from the program, their rental assistance may be made available to the next eligible applicant as determined under regulations established by DHCD, subject to appropriation. Any grievance procedures established for the program shall be consistent with those of the rental voucher program created pursuant to section two of chapter 133 of the acts of 1992.
DHCD shall promulgate rules and regulations to implement the provisions of this section no later than December 1, 2016.
Nothing stated herein shall give rise to enforceable legal rights in any party or an enforceable entitlement to any form of housing and further, nothing stated herein shall be construed as giving rise to such enforceable legal rights or such enforceable entitlement.

The commission shall consist of the following members or their designees: the undersecretary of the department of housing and community development; the secretary of education; the secretary of the department of labor and workforce development, the commissioner of the department of transitional assistance; the president of the senate; the speaker of the house of representatives; the senate and house chairs of the joint committee on housing; one representative of each of the following organizations: Abt Associates, Boston Housing Authority, Cambridge Housing Authority, Citizens’ Housing and Planning Association, Compass Collaborative, Economic Mobility Pathways, Homes for Families, Local Initiatives Support Corporation, Massachusetts Association for Community Action, Massachusetts Chapter of the National Association of Housing and Redevelopment Organizations, Massachusetts Coalition for the Homeless, Massachusetts Law Reform Institute, Massachusetts Union of Public Housing Tenants, Metropolitan Boston Housing Partnership, MIDAS Collaborative, Regional Housing Network of Massachusetts, United Way of Massachusetts Bay and Merrimack Valley, the University of Massachusetts Center for Social Policy.
The commission shall file a report of its findings and recommendations together with drafts of legislation necessary to carry out the recommendations, with the clerks of the senate and the House of Representatives, the senate and house chairs of the joint committee on housing, and the house and senate committees on ways and means not later than March 1, 2017.

A mutual bank, co-operative bank or credit union shall conspicuously publish disclosure in a format readily accessible to members.
(b) For the purposes of this section, a “named executive officer or director” shall mean:
(i) a person serving as a company’s principal chief executive officer or acting in a similar capacity during the last completed fiscal year, the “CEO”, regardless of compensation level;
(ii) a person serving as a company’s principal or chief financial officer or acting in a similar capacity during the last completed fiscal year, the “CFO”, regardless of compensation level;
(iii) a company’s 3 most highly compensated executive officers other than the CEO and CFO who were serving as executive officers at the end of the last completed fiscal year;
(iv) up to 2 additional persons for whom disclosure would have been provided pursuant to clause (iii), but for the fact that the individual did not serve as an executive officer of the company at the end of the last completed fiscal year; and
(v) a company’s directors.
(c) The commissioner of banks shall further promulgate regulations with the express purpose of requiring a mutual bank, co-operative bank or credit union to provide full and accurate disclosure of:
(i) all compensation to the named executive officers or directors, whether paid or accrued; and
(ii) all conflicts of interest, whether direct or indirect.”

For the purposes of this act, state-aided housing projects shall mean, any program, project or fund administered pursuant to chapters 40B, 40Q through 40R, 40T, 40V, 121A through 121B, and 121D through 121G inclusive; provided further that this act shall apply to any person who is a veteran as defined in clause forty-third of section 7 of chapter 4, or who meets all the requirements of said clause forty-third, except that instead of performing wartime service as so defined has performed not less than 90 days’ active service in any of the campaigns or expeditions enumerated in section two of chapter 115A, or who is serving in the armed forces of the United States in an area designated by the President of the United States by executive order as a “combat zone” at any time during the period designated by the President by executive order as the period of combatant activities pursuant to section 62C of chapter 81.
Section 2. The department of housing and community development shall promulgate regulations for the implementation, administration and enforcement of this chapter.
SECTION 2. Subsection 4 of section 3 of chapter 23B of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by adding the following sentences:- provided further, that the department shall promulgate guidelines to allow the following preference categories for local selection preference: (i) current residents; (ii) municipal employees; (iii) employees of local businesses; (iv) households with children attending the locality’s schools; and (v) veterans; provided further, that when determining the preference categories, the geographic boundaries of the local resident preference area should not be smaller than municipal boundaries and may exceed municipal boundaries for veterans."

Massachusetts Veteran Homelessness Commission
Messrs. O'Connor, Tarr, Fattman and Ross moved that the proposed new text be amended by inserting after section ___, the following new section:-
“SECTION__. Notwithstanding any special or general law there shall be a special commission on Veteran homelessness to determine the feasibility of securing permanent housing and long-term stability for Massachusetts veterans, with the goal to effectively reduce the population of sheltered and unsheltered Veterans in Massachusetts to zero. The focus of the commission’s work shall include, but not be limited to, the study of existing homelessness alleviation models in other states and jurisdictions that have proved successful; assessment of the impact of streamlining all relevant federal, state, local, private, and non-profit organization options toward achieving said goal; estimation of targeted population quantity, geography, demographic, and specific needs; make recommendations to reduce identified barriers to serving this population; estimate the cost of reaching a net-zero homeless veterans goal.
The commission shall include, the secretary of Labor and Workforce Development, regional administrator of the Massachusetts Department of Housing and Urban Development, the secretary of the Massachusetts Department of Veterans Services, executive director of the Massachusetts Coalition for the Homeless, President of the New England Center and Home for Veterans, Director of the VA Boston Healthcare System, the Undersecretary of the Massachusetts Department of Housing and Community Development, 2 members of the senate, appointed by the senate president, 2 members of the
house of representatives, appointed by the speaker of the house, 3 veterans who have experienced homelessness, appointed by the president of the New England Center and Home for Veterans, and a representative from each of the following organizations: the Massachusetts Broadband Institute, Veterans Northeast Outreach Center, the Disabled American Veterans Department of Massachusetts, and the Chelsea and Holyoke Soldiers’ Homes.
The commission shall submit a report to the Governor, the speaker of the house of representatives and the president of the senate, the joint committee on veterans and federal affairs, the joint committee on housing, and the department of veterans services no later than (?), setting forth the commission’s findings, together with any recommendations for regulatory or legislative action with a timeline for implementation, cost estimates and finance mechanisms. Thereafter, the commission shall submit a report annually by December 1 of each year to the
Governor, the speaker of the house of representative and the president of the senate, the joint committee on veterans and federal affairs, the joint committee on housing, and the department of veterans services, detailing the extent of homelessness among veterans within the commonwealth and the progress made toward implementing the commission’s recommendations along with other efforts to address the needs of this population."

Job Creation Tax Credit
Messrs. Tarr, O'Connor, Fattman and Ross moved that the proposed new text be amended by inserting, after section__, the following new section:-
"SECTION _. Section 67D of chapter 62C of the General Laws, as appearing in the 2014 Official Edition, is hereby amended by inserting after subsection (g) the following new sections:-
(h) when used in section (i)-(n), the following words shall have the following meaning:
“Application year”, the calendar year for which a business submits the information required for a determination as to a jobs incentive credit.
“Business”, a corporation, sole proprietorship, partnership, limited liability company or any other form of business organization.
“Commissioner”, the commissioner of revenue.
“Eligible Jobs”, a number determined by first multiplying each of the local jobs created by a business during a single calendar year by the job qualifier for that job, and then totaling the number for all of the local jobs created.
“Full time employee”, a person who is employed for consideration for at least 35 hours per week and whose salary is subject to withholding as provided in chapter 62B.
“Job qualifier fraction”, in the case of either a full-time employee or a part-time employee of a business, the figure that determines the extent to which that employee is employed in the commonwealth during a single calendar year. The job qualifier fraction for each employer shall be determined by multiplying the following percentages together: (i) the percentage of time that an employee worked while employed by the company expressed as average hours worked per week out of 35 hours, not to exceed 100 per cent; (ii) that employee’s time attributable to work in the commonwealth, as a portion of that employee’s total work for the company; and (iii) the portion of the year the employee worked for the company.
“Jobs incentive credit”, a business employment incentive credit for companies as provided for in this section.
“Local jobs created”, the total number of jobs created by a business during a single calendar year in which the new employees perform qualified services in at least 1 in-state location, including jobs performed by persons that are transferred within the company to work at an in-state location from a location based outside the state.
“Part-time employee”, a person who is employed for consideration for less than 35 hours a week and whose salary is subject to withholding as provided in chapter 62B.
“Credit years”, in the case of a business that is determined to be eligible for a jobs incentive credit, the 3 calendar years following the application year.
“Weighted, average employment”, for a calendar year, the total number of jobs maintained by a business in which the employees performed employment services in at least 1 in-state location. The number is to be determined by first multiplying each of the individual jobs maintained by the company for that year by the job qualifier fraction for that job and then totaling the number for all of these jobs.
(i) A business that creates an eligible job in the commonwealth during its application year shall be entitled to a jobs incentive credit, spread equally over three calendar years, if its weighted average employment for such application year reflects a net increase over the company’s weighted average employment for the prior calendar year. The total jobs incentive credit shall be equal to 50 per cent of the amount paid by the company as salary attributable to eligible jobs created by the company in such year to the extent that the salary was subject to Massachusetts withholding pursuant to chapter 62B for such year, multiplied by the applicable Massachusetts income tax rate for such salary, and such credit shall be applied toward the company’s liability imposed by Chapter 62B, Section 2. A company shall take a jobs incentive credit for no more than 50 jobs created over its weighted average employment for the prior calendar year. For companies creating greater than 50 jobs over the weighted average employment for the prior calendar year, the total tax credit, which will be taken in three equal installments subject to the terms and conditions in the following sections, shall be determined by the salary of the first 50 eligible jobs created. For the purposes of this provision, an eligible job shall be deemed created in the commonwealth on the first day for which Massachusetts withholding is required in connection with the compensation paid to the employee.
(j) The jobs incentive credit shall be taken by a business in 3 equal installments in each of the 3 calendar years commencing with the calendar year subsequent to the application year. If, for the first or second credit year, the company’s weighted average employment falls below its weighted average for the application year, the company shall be disqualified from taking its second installment credit. It may nonetheless take its third installment credit if its weighted average employment for its second credit year is above its weighted average employment for the application year.
(k) A company that seeks a jobs incentive credit shall apply to the commissioner to receive permission to take such a credit on a form prescribed by the commissioner. This form shall reference the necessary information concerning the eligible jobs created by the company in the Commonwealth during the application year and also the company’s weighted average employment for such year and the prior calendar year. The commissioner shall advise the company of the determination in writing.
(l) Not later than March 1 of each calendar year for which a company has been approved to take a job incentives credit , the company shall submit to the commissioner, in a form prescribed by the commissioner, the information necessary to evaluate the company’s prior year weighted employment average.
(m) A company that has previously been approved to take a job incentive credit is entitled to re-apply for an additional credit for a second or third application year. In such cases, the company may be entitled to take a job incentive credit that relates to different application years in the same calendar year. When a company has previously been granted permission to take a jobs incentive credit for 3 application years, it shall not request an additional jobs incentive credit. In no case shall a company take a jobs incentive credit after June 30, 2016, when all provisions in (i)-(m) shall sunset and no longer be in effect.
(n) Following the termination of the job creation tax credit program, the commissioner of the department of revenue, in consultation with one or more institutes of higher learning, shall conduct a cost benefit analysis of said program, which shall take into consideration the total number of permanent in-state jobs created under the program, the total amount of tax credits provided, and any other factors that would be useful in measuring the success of the program. The commissioner shall prepare a report on the findings, which shall be filed with the clerk of the house of representatives and the clerk of the senate, the chairs of the house and senate committees on ways and means, and the house and senate chairs of the joint committee on revenue no later than September 30, 2016. Said report shall include the commissioner’s findings as to the feasibility of extending the job creation tax credit program beyond the sunset date, along with any recommendations for revising the program to make it more effective in enhancing the creation of jobs.”

Promoting Economic Growth in the Commonwealth

SECTION _. Subsection (c) of section 3 of chapter 63B of the General Laws, as appearing in the 2014 Official Edition, is hereby amended by striking out the first and second sentences and inserting in place thereof the following 3 sentences:— For purposes of this chapter, there shall be 4 required installments for each taxable year, except as otherwise provided by this chapter. The first installment shall be paid on or before the fifteenth day of the third month of the taxable year; the second installment shall be paid on or before the fifteenth day of the sixth month of the taxable year; the third installment shall be paid on or before the fifteenth day of the ninth month of the taxable year; and the fourth installment shall be paid on or before the fifteenth day of twelfth month of the taxable year. The amount of any installment shall be 25 per cent of the required annual payment.”
