"SECTION ____. Chapter 164 of the General Laws is hereby amended by inserting after section 116B the following section:-
SECTION 116C: SMART/WIRELESS UTILITY METER INFORMATION
a) As used in this section, the following terms shall have the following meanings:
(1) “Electromechanical analog meter”, means a purely mechanical device, using no electronic components, no switch mode power supply, no transmitter, no antenna, and no radio frequency emissions
(2) “Utilities”, shall mean an electric, gas, or water company, or town or city-owned utility or other utility provider.
(3) “Wireless meter” shall mean: Any transmitting metering device with electronic components and/or any electric or battery operated meter that is capable of measuring, recording, and sending data from a utility consumer or member to a public utility, municipality, or cooperative association in a manner utilizing one−way communication, two −way communication, or a combination of one−way and two−way communication with any entity or device, or a device ancillary to the meter. (Common names include, but are not limited to, AMR, ERT, smart, AMI, and Comprehensive Advanced Metering Plan CAMP)
(4) “Equivalent Technology” shall mean utility infrastructure such as WiMax that extracts data using wireless frequencies, but which may be undisclosed due to proprietary rights (eg NStar)
b) The department of public utilities shall direct utilities to provide to ratepayers the following:
(1) a choice of the type of utility meters to be installed and operated on their places of residence, property or business;
(2) the ability to retain “Electromechanical analog meter” at no cost
(3) the right to replacement of a wireless meter with a non-transmitting electromechanical meter at no cost
c) The utilities shall be required to obtain the ratepayer’s written consent
(1) before installing wireless meters or equivalent technology on the ratepayer’s property
(2) before altering the functionality of said meters
d) The utilities shall provide written notice to ratepayers within 90 days of the effective date of this act for the purpose of informing said ratepayers if wireless meters have been installed on their properties. Ratepayers shall have the right to request that the utility companies remove said wireless meters and the replacement installation of electromechanical analog meters that emit no radiofrequency electromagnetic radiation at no cost or other periodic usage charges to the ratepayer for such removal, replacement installation, and use of a non-wireless utility meter. The utility company shall promptly comply with such removal and replacement installation request made by the ratepayer to said company.
e) Utility Companies are:
(1) prohibited from shutting off service to a ratepayer based on the amount of utility usage the ratepayer uses or the ratepayer having wireless meters;
(2) prohibited from imposing any disincentive on a ratepayer for not consenting to the installation or use of wireless meters;
(3) required to notify ratepayers in writing that the installation and use of wireless meters are not mandated by state or federal law and are not permitted without the ratepayer’s consent;
(4) prohibited from discriminating against ratepayers who may have medical conditions that are exacerbated by exposures to pulsed microwave radio frequencies;
(5) prohibited from installing wireless repeaters or nodes on poles in lieu of a wireless utility meter on or near the home or business of an individual requesting a non-transmitting meter.
f) The DPU shall insure that MA residents, including those who live in multi-family residences, are not adversely impacted by proximity to wireless utility meters and infrastructure.
g)The DPU shall monitor the safety of utility wireless infrastructure for all MA residents, in accordance with
(1) its mandate to provide the safe and reliable delivery of electricity for all ratepayers
(2) the Universal Declaration of Human Rights, including Article 17 (No one shall be arbitrarily deprived of his property)
(3) requirements for informed consent specified in Federal Regulations for Human Subjects Research, federal regulations (45CFR46) prohibiting experimentation without knowledge or consent
(4) the Precautionary Principle
(5) recommendations of the Jan. 2015 European Economic and Social Committee on Electromagnetic Hypersensitivity
h) The DPU shall establish terms and conditions to comply with the requirements of this section.”

Massachusetts Thoroughbred Breeding Program
Mr. Timilty moved that the proposed new text be amended by adding at the end thereof the following new section;-
SECTION X. Chapter 128 of the General Laws is hereby amended by striking out section 2(g) and inserting in place thereof the following:-
(g) Promote, develop and encourage through the Massachusetts Thoroughbred Breeding Program, the breeding of thoroughbred horses in the commonwealth by offering cash prizes to breeders of such horses in the following manner: the Massachusetts Thoroughbred Breeders Association, Inc. shall from time to time in consultation with the chairman of the racing commission and the program manager for the equine division in the department of agriculture set the percentages for bonuses to be awarded to the breeder of a Massachusetts bred thoroughbred horse, of the purse monies won by said thoroughbred horse in any pari-mutuel running horse race if said horse finishes first, second or third; the percentage for a cash prize to the owner of the stallion, at the time of service to the dam of such purse winner; provided, however, that (i) the stallion stood the breeding season of February through June in the commonwealth, (ii) the horse finishes first, second or third, and (iii) said stallion is registered with the department of food and agriculture; the percentage for a cash prize for the purse monies won by said thoroughbred horse in any unrestricted or restricted pari-mutuel running horse race held within or outside of the commonwealth to the owner of a Massachusetts bred horse if said horse finishes first, second, or third.
The Massachusetts Thoroughbred Breeders Association, Inc. is further authorized to pay cash purses for stakes races to be limited to Massachusetts bred thoroughbred race horses, registered with the Jockey Club and the Massachusetts Thoroughbred Breeders Association, Inc. and The Massachusetts Department of Agricultural Resources from the Massachusetts thoroughbred breeding program at licensed pari-mutuel race meetings authorized by the state racing commission. Such races may be betting or non-betting races and may or may not be scheduled races by the licensee conducting the racing meeting. Purse monies paid by the association under this section may be in such amounts as the association shall determine and may be the sole cash purse for such races or may be supplemental to the cash purses established by the licensee; provided, however, that no person, partnership, corporation or group of persons may receive more than five thousand dollars as a cash prize breeder's award from the association for an individual horse race within the commonwealth.
To be eligible for the prizes provided, a person must be a paid-up member of the Massachusetts Thoroughbred Breeders Association, Inc. or must agree to a one-time annual processing fee.
No person, partnership, corporation, or group of persons shall be eligible for the prizes provided herein unless the following standards are met:
(1) The thoroughbred foal, properly registered with the Jockey Club and the Massachusetts Thoroughbred Breeders Association, Inc. and The Massachusetts Department of Agricultural Resources shall be the foal of a Thoroughbred mare that dropped said foal in the Commonwealth and was bred back to a Massachusetts stallion registered with the Massachusetts Thoroughbred Breeders Association, Inc.. Or:
(2) The Thoroughbred foal, properly registered with the Jockey Club, and the Massachusetts Thoroughbred Breeders Association, Inc. and The Massachusetts Department of Agricultural Resources shall be the foal of a resident Thoroughbred mare that resided continuously in the Commonwealth from the fifteenth day of October of the year of conception. If an in-foal mare is purchased at public auction prior to December 15 (must be a completed public sale, not an RNA or a private transaction after the public sale), she must be domiciled in the Commonwealth within 14 days of the date of purchase and continue such residence through foaling.
(3) In either case the mare is required to stay in the Commonwealth for a continuous stay of not less than 60 days before or after foaling.
(4) Resident in-foal mares require that domicile reports be filed with the Massachusetts Thoroughbred Breeders Association, Inc. by certified mail by October 15 (or 14 days after date of purchase for mares purchased at public auction prior to December 15). All changes in domicile and/or ownership must be reported to the Massachusetts Thoroughbred Breeders Association, Inc. by certified mail within 14 days of the event.
Prior to the first day of August of each year, each person standing a Thoroughbred stallion in the Commonwealth at either public or private service shall file with the Massachusetts Thoroughbred Breeders Association, Inc. (a) a list of all Thoroughbred mares bred to such stallion in that year; and (b) a verified statement representing that said stallion stood the entire breeding season in the Commonwealth.
All stallions and in-foal mares registered with the Massachusetts Thoroughbred Breeders Association, Inc. are subject to on-site inspection at any time to ensure domicile status.
The Massachusetts Thoroughbred Breeders Association, Inc. is authorized to expend up to 12 percent funds for said program for advertising, marketing, promotion, and administration of the Thoroughbred breeding program in the Commonwealth, which may include incentive payments to owners of qualified broodmares and stallions residing in the state of Massachusetts.
The state auditor shall annually audit the books of the Massachusetts Thoroughbred Breeders Association, Inc. to insure compliance with this section.

Restoring the Harbors and Island Waters Maintenance Fund

Section of 13 of Chapter 64A of the General Laws, as appearing in the 2014 edition, is hereby amended by inserting at the end of the paragraph after the words “chapter 131” the following “;and 0.05 percent shall be credited to the Harbors and Island Waters Maintenance Fund, established by section 10A ½ of chapter 91.”
SECTION __. Chapter 91 of the General Laws, as appearing in the 2014 edition, is hereby amended by inserting after section 10A the following new section: - Section 10A ½. There is hereby established a fund to be known as the Harbors and Inland Waters Maintenance Fund to which shall be credited such sums as are determined the provisions of section thirteen of chapter sixty four A, sections forty-two, forty-three, forty-five, forty-six A and forty-nine of chapter ninety-one and any sums received by the commonwealth from the federal government on account of the activities of the department of conservation and recreation relative to (a) the continuous maintenance dredging; (b) cleaning of all the areas within the harbors, inland waters and great ponds of the commonwealth include the removal of sunken and abandoned vessels, derelict piers and any other obstacles deemed to be hazardous to navigation; (c) maintenance of state piers; and (d) for the purpose of carrying out the provisions of section thirty-one. All monies in said fund shall be subject to appropriation, and shall be used only for the purpose of continuous maintenance dredging and cleaning of harbors, inland waters and great ponds of the commonwealth, including removal of sunken and abandoned vessels, derelict piers and any other obstacles deemed to be hazardous to navigation, by the department of conservation and recreation.

“SECTION 23A. The General Laws are hereby amended by inserting after chapter 21O the following chapter:-
CHAPTER 21P. The Plastic Bag Reduction Act
Section 1. As used in this chapter the following words shall have the following meanings, unless the context clearly requires otherwise:-
“Postconsumer recycled material”, a material that would otherwise be destined for solid waste disposal, having completed its intended end use and product life cycle; provided, however, that postconsumer recycled material does not include materials and byproducts generated from, and commonly reused within, an original manufacturing and fabrication process.
“Recycled paper bag”, a paper bag that is 100 per cent recyclable and displays the words "Reusable" and "Recyclable" in a visible manner on the outside of the bag.
“Reusable grocery bag”, a bag with handles that is specifically designed and manufactured for at least 125 uses and is either: (i) made of cloth or other machine washable fabric; or (ii) made of durable plastic that is at least 3 millimeters thick; or (iii) made of other durable material.
“Single-use carryout bag”, a bag made of plastic, paper or other material provided by a store to a customer at the point of sale and that is not a recycled paper bag or a reusable grocery bag; provided, however, that a single-use carryout bag does not include the following: (i) a bag provided by a pharmacy to a customer purchasing a prescription medication; (ii) a non-handled bag used to protect items from damaging or contaminating other purchased items placed in a recycled paper bag, a reusable grocery bag, or a compostable plastic bag; (iii) a bag provided to contain an unwrapped food item; or (iv) a non-handled bag that is designed to be placed over articles of clothing on a hanger.
“Store”, a retail establishment with: (i) gross interior space of 3,000 square feet or larger, exclusive of stockroom, office, storage and other space ancillary of a publicly accessible space intended to be frequented by consumers; or (ii) at least 3 locations under the same ownership or brand name within the commonwealth.
Section 2. (a) A store shall not provide a single-use carryout bag to a customer at the point of sale.
(b) A store may make available for purchase at the point of sale a reusable grocery bag or recycled paper bag for a charge of not less than 10 cents.
(c) The department of environmental protection shall promulgate regulations to enforce this chapter.
Section 3. Nothing in this chapter shall preempt further limitation of single-use carryout bags by the commonwealth or any political subdivision of the commonwealth consistent with this chapter; provided, however, that this chapter shall preempt, supersede or nullify any inconsistent, contrary or conflicting state or local law.”; and
by inserting after section 78 the following section:-
“SECTION 78A. Section 23A shall take effect on August 1, 2018.”.

Municipality Reimbursement
Mr. Rodrigues moved that the proposed new text be amended by inserting the following section:-
SECTION __. Notwithstanding any general or special law to the contrary, the department of energy resources shall expend an amount not to exceed $3,000,000 in fiscal year 2017 from the RGGI Auction Trust Fund established in section 35II of chapter 10 of the General Laws for reimbursements to municipalities in which the property tax receipts from an electric generating station, including payments in lieu of taxes and other compensation specified in an agreement between a municipality and an affected property owner, are reduced due to a reduction in capacity factor, occurring after July 1, 2012 at a dual coal and oil-fired facility, of at least 50 per cent from the average capacity factor of the previous 10 years provided that such action also reduces the commonwealth’s greenhouse gas emissions from the electric generator sector under the goals established pursuant to chapter 21N of the General Laws; provided, however, that the amount of such reimbursements shall be determined by calculating the difference between: (1) the amount of the tax receipts, including payments in lieu of taxes or other compensation, paid by the electric generating station in the current tax year; and (2) the amount of the tax receipts, including payments in lieu of taxes or other compensation, paid by the electric generating station in the tax year prior to the full or partial decommissioning or other change in operating status of the facility; provided further, that reimbursement shall not be made if, in a tax year, the aggregate amount paid to a municipality by the owner of an electric generating station including, but not limited to, payments in lieu of taxes and other compensation, exceeds the aggregate amount paid to that municipality by that owner in the year prior to the full or partial decommissioning or other change in operating status of the electric generating station; and provided further, that not later than December 31, 2016, a municipality in which the property tax receipts from an electric generating station are reduced due to a reduction in capacity factor shall submit a report to the joint committee on telecommunications, utilities and energy detailing the need for such reimbursements and the impact on the municipality of receiving or not receiving such reimbursements. Payments from the RGGI Auction Trust Fund shall be prioritized so that the first payments from the fund shall be made to municipalities under this section.

Farmland Action Plan
Ms. Gobi, Ms. Flanagan, Messrs. Humason, Brownsberger, Lesser and Moore moved that the proposed new text be amended by inserting, after section XX, the following new section :-
SECTION XX. (a) Notwithstanding any general or special law to the contrary, the secretary of energy and environmental affairs, in consultation with the farmland protection and viability advisory commission established into subsection (b), shall develop a farmland action plan. The plan shall set forth the commonwealth’s goals, priorities and recommended actions for farmland protection and access to reflect the importance of farmlands of the commonwealth to its citizens who derive their livelihoods from farming and the importance of protected farmland for ecosystem health and biodiversity.
The plan shall include, but not be limited to: (i) an inventory of state land in active agricultural production or that is potentially suitable for farming; (ii) a review of state agency policies related to the use or lease of land for farming and recommendations related to state policies for the use and lease of state-owned land for farming; (iii) an analysis of recent trends and potential threats related to farmland loss and conversion and its recommendations, including resources necessary to improve state data collection for farmland trends and to establish a system for tracking acres of farmland in production over time; (iv) recommended statutory, regulatory or policy revisions to the agricultural preservation restriction program to support the long-term economic viability of protected farms, to address housing needs and to ensure the program is managed in a transparent and consistent manner and with policies that keep pace with changes in agriculture and associated markets; (v) an analysis of farmland enrolled in a program under chapter 61A of the General Laws and recommendations for improving enrollment of farmland in the program; and (vi) measurable statewide goals and benchmarks related to farmland conversion, farmland protection and farmland access and recommendations for state policy changes and program funding levels to meet these goals and benchmarks. The plan may include maps, illustrations and other media and shall be based on best available science and best management practices.
(b) There shall be a farmland protection and viability advisory commission to assist the secretary in developing the farmland action plan. The commission shall consist of: 2 members of the senate or a designee, 1 of whom shall be appointed by the minority leader; 2 members of the house of representatives or a designee, 1 of whom shall be appointed by the minority leader; 1 member of the board of food and agriculture; the commissioner of agricultural resources or a designee; a representative of the Center for Agriculture, Food and the Environment at the University of Massachusetts at Amherst; a representative of the Massachusetts Farm Bureau Federation; a representative of The Trustees of Reservations; a representative of the American Farmland Trust; and 4 persons to be appointed by the governor, 1 of whom shall be a farmer, 1 of whom shall be a representative of an urban agriculture organization, 1 of whom shall be a representative of a farmland access organization and one of whom shall be the chair and shall also be a farmer.
The advisory commission shall meet at least quarterly and otherwise at the discretion of the chair. The commission shall make recommendations to the secretary for the proper management and development of the farmland action plan. The secretary shall consider the recommendations of the commission.
(c) The farmland action plan shall be delivered to the joint committee on environment, natural resources and agriculture not later than December 31, 2017. The executive office of energy and environmental affairs and the department of agricultural resources shall provide technical support to the commission.
(d) The secretary shall develop and implement a public outreach and information program to provide information to the public regarding the farmland action plan.

Notwithstanding any general or special law, rule or regulation to the contrary no new fossil fuel transmission pipelines shall be located in an area which is less than 1 mile in linear distance from a playground, licensed day-care center, school, church, area of critical environmental concern, as determined by the secretary of environmental affairs pursuant to 301 CMR 12.00, or an area occupied by residential housing. This linear distance shall be measured from any point along a fossil fuel transmission pipeline to the outermost point of the aforementioned zones; provided, however, that repairs or replacements that do not increase capacity in any such pipeline in operation prior to January 1, 2017, shall not be subject to this section.

Borderland State Park Trust Fund

“SECTION XX. (a) Chapter 92 of the General Laws, as appearing in the 2010 official edition, is hereby amended by inserting after section 34C the following section:-
Section 34D. Notwithstanding any general or special law or administrative bulletin to the contrary and pursuant to section 34, there is hereby established and set up on the books of the commonwealth a separate fund, to be known as the Borderland State Park Trust Fund, which shall be used for the purposes of advancing recreational, educational and conservation interests, including, but not limited to, the construction and maintenance of facilities and infrastructure improvements for the area within the reservation. The trust shall receive, hold and expend with the advice of the Borderland Advisory Council, all fees generated by parking, permits, licenses and all other agreements not currently being directed to the General Fund relating to the use of the park land as authorized by the commission. The department shall not make expenditures from this fund so as to cause the fund to be deficient.
(b) This law shall be commonly be referred to as "The William Hocking Law"
(c) This act shall take effect upon passage.”

Municipal Dog Park Construction

“Section __. Chapter 10, as appearing in the 2014 Official Edition, is hereby amended by inserting after section 35CCC the following new section:-
Section 35DDD. There is hereby established on the books of the commonwealth a separate fund known as the Commonwealth Municipal Dog Park Trust Fund to be used, without further appropriation, to provide matching grants to municipalities for the construction and maintenance of fenced-in dog parks. Any balance in the fund at the end of the fiscal year shall not revert to the General Fund, but shall remain available for expenditure in subsequent fiscal years. Said trust fund shall consist of all revenues received by the commonwealth under the provisions of law authorizing the voluntary check-off donation indicated on the department of revenue’s annual individual income tax return, pursuant to section 6O of chapter 62 and any public and private sources as gifts, grants, and donations to further provide for the construction and maintenance of fenced-in dog parks.
The state treasurer shall deposit monies in said fund in accordance with the provisions of sections 34 and 34A of chapter 29 in such manner as will secure the highest interest rate available consistent with safety of the fund and with the requirement that all amounts on deposit be available for immediate withdrawal at any time by the commissioner of the department of conservation and recreation.
Section __. Chapter 62, as so appearing, is hereby amended by inserting after section 6N the following new section:-
Section 6O. Every individual who files a separate return and every husband and wife filing a return jointly may voluntarily contribute all or part of any refund to which they are entitled, or may voluntarily add an amount onto any amount due, to be credited to the Commonwealth Municipal Dog Park Trust Fund established pursuant to section 35DDD of chapter 10.
A contribution made under this section may be with respect to any taxable year at the time of filing a return of the tax established by this chapter for such taxable year; provided, however, that the commissioner shall prescribe the manner in which such contribution shall be made on the face of the return required by section 5 of chapter 62C; provided, further, that the commissioner shall assure that taxpayers filing any such forms are made clearly aware of their ability to make the contributions provided for by this section.
The commissioner shall annually report the total amount designated under this section to the state treasurer, who shall credit such amount to said Commonwealth Municipal Dog Park Trust Fund.
Section __. Chapter 21A, as so appearing, is hereby amended by inserting after section 26 the following new section:-
Section 27. (a) There shall be, within the department of conservation and recreation, a Commonwealth Municipal Dog Park Program to encourage the construction of fenced-in dog parks. A board of trustees shall be appointed to manage the program and oversee use of the Commonwealth Municipal Dog Park Trust Fund, established pursuant to section 35DDD of chapter 10. The board shall consist of the commissioner of the department of conservation and recreation, or his designee, who shall serve as chair; the treasurer, or his designee; the president of the Retailers Association of Massachusetts, or his designee; the president of the Massachusetts Municipal Association, or his designee; and three persons to be appointed by the governor, 1 of whom shall have experience in municipal planning, 1 of whom shall be a representative from the pet supply retail industry, and 1 of whom shall be a representative of an animal safety nonprofit organization.
(b) The objectives of the program shall include, but shall not be limited to: (1) establishing an application and selection process for municipalities seeking supplemental funding for municipally-sanctioned dog park projects; (2) pursuant to said process, awarding matching grants to selected municipalities for the construction and maintenance of fenced-in dog parks; and (3) establishing partnerships with pet supply retailers to solicit donations for the Commonwealth Municipal Dog Park Trust Fund from consumers.
(c) The board shall report annually not later than March 1 to the secretary of administration and finance and to the house and senate committees on ways and means. The report shall include: (1) matching grants awarded pursuant to the program in the prior calendar year; (2) activities undertaken in furtherance of the program’s objectives; and (3) the total expenditures from the fund in the prior calendar year.”
