Dedham Westwood Water District Creditable Service

Mr. Rush moved that the proposed new text be amended <w:p><w:r><w:t xml:space="preserve">by inserting, after section 77, the following new section:-

SECTION 77A.  Notwithstanding any general or special law to the contrary, not later than July 31, 2016, the public employee retirement administration commission shall submit a request to the Internal Revenue Service for a letter of determination or a ruling on whether chapter 192 of the acts of 2014 may be implemented without impairing the compliance of the Norfolk county retirement system or the public employee retirement administration commission with the Internal Revenue Code of 1986 as qualified pension systems.  The public employee retirement administration commission shall ensure that all relevant and necessary documentation is submitted to the Internal Revenue Service to assist in responding to the request.

The "Roxbury Trust Fund Committee"

Ms. Chang-Diaz moved that the proposed new text be amended by inserting, after section __, the following new section:-

SECTION XX.

Section 1 of chapter 443 of the acts of 1990, as amended by chapter 296 of the acts of 1995, is hereby amended by striking out the fourth paragraph and inserting in place thereof the following paragraph:-

The "Roxbury Trust Fund Committee" shall mean a committee with a size, membership, and term length determined by the Trustees in accordance with the Declaration of Trust of the Roxbury Trust Fund Committee Trust (the "Trust"), as may be amended from time to time by at least a majority of the Trustees, except that such membership shall include, as ex officio Trustees, the sitting State Senator of the district or his or her designee, the sitting State Representatives of the district or their respective designees, and the sitting Mayor of Boston or his or her respective designee. The ex officio Trustees shall be eligible to vote on amendments to the aforementioned Declaration of Trust, but shall be non-voting Trustees for all other purposes. The Roxbury Trust Fund Committee shall not be prohibited (i) from exercising at any time or times all powers necessary to carry out the purposes of the Trust, such purposes include operating for any charitable, scientific, literary, or educational purpose, nor (ii) from raising, collecting, and expending funds, property, or other assets necessary to support or sustain such purposes.

"SECTION ___. (a) Notwithstanding any general or special law to the contrary, after complying with clause (a) of section 5C of chapter 29 of the General Laws, the comptroller shall dispose of the consolidated net surplus in the budgetary funds for fiscal year 2016 by transferring: (i) $10,000,000 to the Massachusetts Community Preservation Trust Fund, established by section 9 of chapter 44B of the General Laws; (ii) $10,000,000 distributed to municipalities of the Commonwealth in the manner prescribed by clause (c) of the second paragraph of section 35 of chapter 10 of the general laws; and (iii) any remaining funds shall be deposited into the commonwealth stabilization fund.

(b) All transfers pursuant to this section shall be made from the undesignated fund balances in the budgetary funds proportionally from the undesignated fund balances; provided, however, that no such transfer shall cause a deficit in any of the funds.

The exact boundaries of the state highway yard land located at Granite Avenue in the town of Milton shall be determined by the secretary of transportation after completion of a survey. The parcel may be conveyed by deed without warranties or representations by the commonwealth. The Massachusetts Department of Transportation may also release any other property interests it holds in the property to be conveyed to the town of Milton hereunder, for nominal consideration.”

Notwithstanding any general or special law to the contrary, 15 percent of any revenue collected in fiscal year 2017 that is above the original benchmark, as reported by the Department of Revenue, shall be distributed to cities and towns in accordance with the distribution of the balance of the State Lottery Fund, as paid from the General Fund in accordance with clause (c) of the second paragraph of section 35 of chapter 10 of the General Laws.  Any funds distributed under this section shall be considered one-time funding, and shall not be considered part of a municipality’s Unrestricted General Government Aid; provided further, the distribution shall in no way constitute a new and continuing funding source for cities and towns."

The Massachusetts Port Authority shall expend not less than $2,500,000 within 18 months for homes and school buildings in the town of Milton in the Boston Logan Airport Sound Insulation program; provided, however, that if homes and school buildings in the town of Milton are not currently eligible under federal law for the Boston Logan Airport Sound Insulation program, the Authority shall formally request and vigorously pursue a waiver from the Federal Aviation Authority to allow for sound insulation for homes and school buildings in the town of Milton. Funds shall first be expended for the homes and school buildings most impacted by overflight traffic, accounting for both frequency and elevation.".

Mr. Brady moved that the proposed new text be amended in section 2, in item 7061-0011, “ For a reserve to: (i) provide relief to school districts whose section 3 aid has been negatively impacted by a change in the low-income calculation of their foundation budget as defined by said section 3; provided, that eligible districts shall be those whose said section 3 aid would be greater as calculated under the guidelines of section 3 of chapter 46 of the acts of 2015; provided further, that the distribution of funds shall be determined by the department on a basis that addresses this shortfall; provided further, that funds distributed from this item shall be considered prior year aid for fiscal year 2018; and (ii) to provide no less than 250,000 for extraordinary relief as specified under clause (iii) in item 7061-0011 of chapter 46 of the acts of 2015; provided further, that funds distributed from this item for the purposes of clause (i) shall be considered prior year aid for fiscal year 2018; and provided further, that the department shall make not less than 80 percent of the funds available for awards on or before October 15, 2016……….$10,000,000”

Notwithstanding any general or special law to the contrary, 50 percent of any of the unexpended and unencumbered balances of appropriations on June 30, 2016, or $50,000,000, whichever is less, shall be distributed to cities and towns in accordance with the distribution of the balance of the State Lottery Fund, as paid from the General Fund in accordance with clause (c) of the second paragraph of section 35 of chapter 10 of the General Laws. The distribution authorized by this section shall be executed not later than October 31, 2016; provided further, that any funds distributed under this section shall be considered one-time funding, and shall not be considered part of a municipality’s Unrestricted General Government Aid in fiscal year 2017 and 2018; provided further, the distribution shall in no way constitute a new and continuing funding source for cities and towns.”
