Further Clarifying the Definition of Fentanyl Trafficking
Representatives Whelan of Brewster, Tucker of Salem, Jones of North Reading, Orrall of Lakeville, Ferguson of Holden, Vieira of Falmouth, Hunt of Sandwich, Muradian of Grafton, Muratore of Plymouth, Crocker of Barnstable, D'Emilia of Bridgewater, Lyons of Andover, Gonzalez of Springfield, Dwyer of Woburn, Linsky of Natick, Finn of West Springfield, Howitt of Seekonk, Kane of Shrewsbury, Peake of Provincetown, Cahill of Lynn, Dooley of Norfolk, McKenna of Webster, Puppolo of Springfield, Farley-Bouvier of Pittsfield, Kuros of Uxbridge, DeCoste of Norwell, Garry of Dracut, Campanale of Leicester and Kafka of Stoughton move to amend the bill by adding the following section:
"SECTION XXXX: Section 32E of chapter 94C of the General Laws is hereby amended by striking out subsection (c1/2), as inserted by chapter 136 of the acts of 2015, and inserting in place thereof the following subsection:-
(c1/2) Any person who traffics in fentanyl, by knowingly or intentionally manufacturing, distributing, dispensing or possessing with intent to manufacture, distribute or dispense or by bringing into the commonwealth a net weight of 10 grams or more of any mixture containing fentanyl or a derivative of fentanyl shall be punished by a term of imprisonment in state prison for not more than 20 years."
