Amendment #53 to H3600
Contaminated shellfish fee
Representatives Fiola of Fall River, Haddad of Somerset, Schmid of Westport, Silvia of Fall River and Howitt of Seekonk move to amend the bill by inserting the following section:
"SECTION X. (a) Notwithstanding any general or special law to the contrary, the division of marine fisheries, which under chapter 130 of the general laws is responsible for the enforcement, monitoring, and oversight of the harvesting and transplantation of contaminated shellfish in the coastal waters of the commonwealth, shall provide a city or town a reasonable fee under this section if shellfish as defined in section 1 of chapter 130 have been removed or taken from areas declared to be contaminated by the division under section 74 of said chapter 130 which have originated within coastal waters under the jurisdiction of said city or town.
(b) A city or town qualifying under subsection (a) shall receive a fee from the division for the amount of shellfish harvested that have originated within coastal waters under the jurisdiction of the qualifying city or town. The division may develop an application process for any city or town that meets the criteria under this section."
