Amendment #742 to H3600
ServSafe Narcan Requirement
Representatives Cahill of Lynn and Donahue of Worcester moves to amend the bill by adding the following section:-
“Section X. Chapter 94 of the General Laws, as appearing in the 2014 Official Edition, is hereby amended by inserting after Section 205E the following section:-
Section 305F. Each restaurant, having a seating capacity of twenty-five persons or more, shall have on its premises a device approved by the department of public health under the Health Approved Opioid Overdose Prevention Program under G.L. c. 94C that is designed and intended for use in preventing an overdose by an individual who consumed opioids shall have on its premises, when food is being served, an employee trained in manual procedures approved by the department of public health to administer Naloxone. The department of public health may adopt regulations listing all approved devices and manual procedures which it determines may be used effectively to prevent an overdose by opioids. Each such restaurant shall make adequate provisions for insurance to cover employees trained in rendering such assistance. Any person, or employee of any person who, in good faith, volunteers to administer or attempts to administer Naloxone in an emergency shall not be liable for any civil damages as a result of any acts or omissions by such person or employee in rendering such emergency assistance.".
