Language Amendment to HIV Drug Rebate Program

Representatives Lewis of Framingham, Malia of Boston, Peake of Provincetown, Kaufman of Lexington, Walsh of Framingham, Barber of Somerville, Khan of Newton, Connolly of Cambridge, Higgins of Leominster, Tosado of Springfield, Provost of Somerville, Cantwell of Marshfield, Gentile of Sudbury, Rogers of Cambridge, Fernandes of Falmouth, Murray of Milford, Williams of Springfield, Kocot of Northampton, McMurtry of Dedham, Garballey of Arlington, Farley-Bouvier of Pittsfield, Keefe of Worcester, Cahill of Lynn, Cutler of Duxbury, Vega of Holyoke, Day of Stoneham, Dykema of Holliston, Livingstone of Boston, Linsky of Natick, Matias of Lawrence, Decker of Cambridge and Benson of Lunenburg move to amend the bill in section 2, by striking out item 4512-0106, and inserting the following:

 

4512-0106 For the department of public health, which may expend not more than $7,500,000 from revenues received from pharmaceutical manufacturers participating in the section 340B rebate program of the Public Health Service Act, administered by the federal Health Resources and Services Administration and the Office of Pharmacy Affairs, for activities eligible through the Ryan White Program, with priority given to the human immunodeficiency virus and acquired immune deficiency syndrome drug assistance program; provided, that any excess rebate revenue collected beyond the ceiling of this appropriation will be deposited in the general fund; provider further, that services in an amount equivalent to the amount deposited in the general fund be funded through the 4512-0103 appropriation; and provided further, that these services shall include activities that would be eligible for coverage through the Ryan White Program. Notwithstanding any general or special law to the contrary, the department of public health may make expenditures from the start of each fiscal year from this account in anticipation of receipt of rebate revenues from pharmaceutical manufacturers.
