Amendment #9 to H3768

Craft Cultivator Program

Ms. Peake of Provincetown moves to amend the bill in Section 2, in line 85, by adding the following:

“Craft Cultivator Marijuana Cooperative”, a type of marijuana cultivator that is a cooperative comprised of residents of the Commonwealth.

and further in said section, in line 908, by adding the following new subsection:

(c) The Commission shall administer a Craft Marijuana Cultivator Marijuana Cooperative program in order to promote and encourage full participation in the regulated marijuana industry by farmers and small businesses.  In addition to the requirements of subsection (a) of this section, the Commission may issue cannabis licenses pursuant to this section provided that:

1.Ownership interest in a marijuana cultivator cooperative is limited to not more than 40% by any one single individual or entity.

2.A marijuana cultivator cooperative be limited to not more than 15,000 square feet of growing space cultivation capacity.

3.The fee for any license issued pursuant to this subsection be not more than $5,000 and be set consistent with the square footage growing space cultivation capacity of the marijuana cultivation cooperative but not be less than $500.
