Amendment #15 to H4011

To protect victims of domestic violence

Mr. Whelan of Brewster moves to amend the amendment by adding a new section.

Section XXXX.  Said section 13M of Chapter 265 of the General Laws is hereby amended by striking out paragraph two and inserting in it's place the following:-  (b) Whoever is convicted of a second offense of assault or assault and battery on a family or household member shall be punished by imprisonment in the house of correction for not more than 21/2 years or by imprisonment in the state prison for not more than 5 years.  Whoever is convicted of a third or subsequent offense of assault or assault and battery on a family or household member shall be punished by imprisonment in the state prison for not more than 10 years.
