Amendment #18 to H4011

Constable Commission

Mr. Cahill of Lynn moves to amend the amendment by adding the following section:

SECTION XX. Notwithstanding any special or general law to the contrary, there shall be a special commission established to investigate and study the statutory authority, operations, and training of constables. The commission shall consist 11 members: 1 of whom shall be the secretary of public safety and security or the secretary’s designee; 1 of whom shall be a member of the Massachusetts trial court; 1 of whom shall be a member of the house of representatives appointed by the speaker of the house; 1 of whom shall be a member of the senate appointed by the senate president; 1 of whom shall be a member appointed by the Massachusetts district attorney association; 1 of whom shall be a member appointed by the Massachusetts sheriffs association; 1 of whom shall be a member e appointed by the Massachusetts bar association; 1 of whom shall be a member appointed by the Massachusetts chiefs of police association; 1 of whom shall be a member appointed by the Massachusetts constables coalition; 1 of whom shall be a member appointed by the Massachusetts constables association;  1 person appointed by the governor who shall be a member of the public with experience in civil process.

The commission shall file the findings of its study by May 31, 2018, with the clerks of the house and the senate, who shall forward the report to the chairmen of the house committee on ways and means, the senate committee on ways and means, and the joint committee on the judiciary.
