Penalty for heroine trafficking resulting in a death

Mr. Lyons of Andover moves to amend the amendment by inserting at the end thereof the following new sections:-

SECTION XX. Chapter 94C, section 32E of the General Laws is hereby amended by inserting, after subsection (c) (4), the following section:- (5) Any persons found guilty of trafficking heroin or fentanyl that results in the death of the user is to be punished by the terms set forth in Chapter 265, Section 13 of the Massachusetts General Laws.
