Amendment #853 to H4400

MassHealth and Psychiatric Hospitals

Representatives Garlick of Needham, Cronin of Easton, Linsky of Natick, Balser of Newton, Tosado of Springfield, Khan of Newton, Campbell of Methuen, Rogers of Cambridge, Provost of Somerville, Crocker of Barnstable, Smizik of Brookline, Whipps of Athol, Ultrino of Malden, Puppolo of Springfield, Finn of West Springfield, Gentile of Sudbury, Fiola of Fall River and Ashe of Longmeadow move to amend the bill by adding the following section:

"SECTION XXXX. Provided further, that notwithstanding the provision of any general or special law to the contrary, no agreements between MassHealth and the Centers for Medicare and Medicaid Services shall result in the imposition of any retrospective or prospective financial assessments or recoveries on Institutions for Mental Disease licensed by the Department of Mental Health for payments received from the division; its managed care contractors or behavioral management firms for medically necessary services provided to MassHealth patients aged 21-64".
