An Act authorizing the town of Lenox to convey a certain parcel of land to Massachusetts Audubon Society, Inc. in exchange for 2 parcels of land in the town of Lenox.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding chapter 30B of the General Laws, but subject to paragraphs (a), (b) and (g) of section 16 of said chapter 30B, the town of Lenox may convey a certain parcel of land containing 105 acres, more or less, located in the town of Lenox on the town line of Lenox and Richmond, and identified on the town of Lenox assessor’s map as map 26, lot 2, owned by the town of Lenox pursuant to chapters 110 and 423 of the acts of 1869, to Massachusetts Audubon Society, Inc..
SECTION 2. As a condition for the conveyance authorized in section 1, Massachusetts Audubon Society, Inc. shall convey 2 parcels of land to the town of Lenox, as follows: the first being a parcel of land containing 48 acres, more or less, located on West Mountain road in the town of Lenox, identified on the town of Lenox assessor’s map as map 21, lot 4 and described in a deed recorded with the Berkshire middle district registry of deeds in book 1053, page 896; and the second being a parcel of land containing 81.8 acres, more or less, located on West Dugway road in the town of Lenox, identified on the town of Lenox assessor’s map as map 22, lot 10 and described in a deed recorded with the Berkshire middle district registry of deeds in book 1464, page 269; provided that the instrument conveying said parcels shall provide that the parcels are to be used for open space, recreation and conservation purposes.
SECTION 3. This act shall take effect upon its passage.
