Mr. Livingstone of Boston moves to amend the bill by striking SECTION 26 and replacing it with the following:-

“Nothing in the above sections shall permit the use of or sale and delivery of tobacco products as defined herein in which the use of or sale and delivery of tobacco products is or may hereafter be prohibited by law including, without limitation: any other law or ordinance or by-law, or any fire, health or safety regulation. Nothing in the above sections shall preempt further limitation of the use of or sale and delivery of tobacco products as defined herein by the commonwealth or any department, agency or political subdivision of the commonwealth.”
