Preserving municipal oversight over open space
Representatives Lewis of Framingham, Higgins of Leominster and DuBois of Brockton move to amend the bill by striking out section 73 and inserting in place thereof the following section:
"SECTION 73 Subject to any general law, special law, or municipal bylaw, upon acquiring any fee interest in land for purposes pursuant to Article XCVII of the Amendments to the Constitution, any state agency, commission, or board expending or receiving state funds under this act may only implement or endorse fishing, hunting, or trapping on said land by (a) obtaining the approval of (1) the secretary of energy and environmental affairs; and (2) the mayor and city council under Plan A, B, C or F; or the city manager and the city council under Plan D or E; and the conservation commission of the municipality, within which the land lies; and (b) providing the secretary and the municipal officials with written justification 45 days before seeking to obtain the approval described in subsection (a)".
