Prohibiting Retroactive Denials of Emergency Services

Ms. Malia of Boston moves to amend the bill by adding at the end of SECTION 102, Section 28 (a), in line 2311, after the word "plan" the following words:- “; provided further that an insurer shall not deny payment to screen for, evaluate, diagnose and/or treat an emergency medical condition when the diagnosis is retrospectively determined not to have required emergency care”.
