Prohibiting Retroactive Denials for Emergency Services

Mr. Kafka of Stoughton moves to amend the bill by adding, in SECTION 102, in line 2311, after the word "plan" the following words: “provided further, that an insurer shall not deny payment to screen for, evaluate, diagnose and/or treat an emergency medical condition when the diagnosis is retrospectively determined not to have required emergency care."
