Preserving Local Control

Messrs. O'Connor and Moore move to amend the bill in Section 11 by striking Subsection 3(a) and inserting thereof the following new subsection:-

"A city or town may adopt ordinances and by-laws to further restrict or regulate the operation of marijuana establishments, provided that a zoning ordinance or by-law shall not prohibit the placement of a marijuana establishment that cultivates, manufactures or sells marijuana or marijuana products in an area in which a medical marijuana treatment center is registered to engage in the same type of activity, and that:”

Section 11 is hereby further amended by inserting after subsection 3(a) the following new subsection:-

"(X) Any ordinance or by-law that is adopted by a city or town to further restrict or regulate the operation of marijuana establishments, provided that a zoning ordinance or by-law shall not prohibit the placement of a marijuana establishment that cultivates, manufactures or sells marijuana or marijuana products in an area in which a medical marijuana treatment center is registered to engage in the same type of activity, may not be overridden by the Commission."
