Traceable Death by Heroin Overdose

Messrs. O'Connor and Ross, Ms. Gobi and Mr. Timilty move to amend the bill by striking Section 44 in its entirety.

Mr. O'Connor moves to further amend the text by inserting the following new section:-

SECTION XX. Section 32E of Chapter 94C is hereby amended by adding, at the end of subsection (c), the following new clause:-

(5) Directly traceable to an overdose and resulting death, be punished by imprisonment in the state prison for not more than twenty years or by a fine of not more than one thousand dollars and imprisonment in jail or a house of correction for not more than two and one half years.
