Insurance Coverage for Dependents over age 26 with Disabilities 2

Ms. L'Italien moves to amend the bill by adding the following sections:

 

SECTION XX.  Subdivision (P) of Section 110 of Chapter 175, as appearing in the 2016 Official Edition, is hereby amended by striking, in line 463, the words “under 26 years of age” and inserting in place thereof the following words:-  “until the dependent’s 26th birthday or without regard to age if they are incapable of self-sustaining employment due to disability. For purposes of this section, “disability’ means the inability to engage in any substantial gainful activity by reason of any medically determinable physical or mental impairment which can be expected to result in death or which has lasted or can be expected to last for a continuous period of not less than 12 months.

 

 

SECTION XX.  Section 4T of Chapter 176G of the General Laws, as appearing in the 2016 Official Edition, is hereby amended by striking, in line 6, the words “under 26 years of age” and inserting in place thereof the following words:-  “until the dependent’s 26th birthday or without regard to age if they are incapable of self-sustaining employment due to disability. For purposes of this section, “disability’ means the inability to engage in any substantial gainful activity by reason of any medically determinable physical or mental impairment which can be expected to result in death or which has lasted or can be expected to last for a continuous period of not less than 12 months.

 

 

SECTION XX.  Section 1 of Chapter 176J of the General Laws, as appearing in the 2016 Official Edition, is hereby amended by striking, in line 85, the words: “the end of the child’s twenty-sixth year of age” and inserting in place thereof:- “a child’s 26th birthday or without regard to age if they are incapable of self-sustaining employment due to disability. For purposes of this section, “disability’ means the inability to engage in any substantial gainful activity by reason of any medically determinable physical or mental impairment which can be expected to result in death or which has lasted or can be expected to last for a continuous period of not less than 12 months.
