Amendment #37 to S2509

US Public Health Service Retirement

Representatives Gentile of Sudbury, Lewis of Framingham and DeCoste of Norwell move to amend the bill by adding the following section:

"SECTION  XXXX. Subdivision (1) of section 4 of said chapter 32, as so appearing, is hereby amended by inserting after paragraph (r) the following paragraph:-

(r1/2) Notwithstanding any general or special law to the contrary, a member in service as defined in section 1 who served in the of the United States Public Health Service Commissioned Corps or the National Oceanic and Atmospheric Administration Commissioned Officer Corps and who has completed at least 4 years of membership service and who retires on or after January 1, 1975 shall receive full credit for the period of such service. Eligibility for the creditable service of members in service shall be conditioned upon payment into the annuity savings fund of the applicable retirement system, in 1 sum or in installments upon such terms as the applicable retirement board may provide, of an amount equal to the contributions that member would have otherwise paid into the retirement system plus buyback interest thereon for the period of commissioned corps service based upon the annual salary the member received in the first year of membership service after the member's commissioned corps service."
