Impossibility of performance

Messrs. Tarr and Ross move that the proposed new draft be amended in section 5, by striking out, in line 94, the words “or (iii)” and inserting in place thereof the following words:- “(iii) providing sufficient evidence of impossibility of performance, not caused by or resulting from a violation of law; or (iv)”.
