Redraft Amendment 2

Side Guards

Mr. Brownsberger moves that the proposed new draft be amended by striking out, in line 35, the words “or agricultural tractor” and inserting in place thereof the following words:- “, agricultural tractor or any other class or type of vehicle as determined by the registrar”; and

in said section 6, in the proposed fourth paragraph of section 7 of chapter 90 of the General Laws, by striking out the final sentence; and

by inserting after section 7 the following section:-

“SECTION 7A. The fourth paragraph of said section 7 of said chapter 90, as appearing in section 6, is hereby further amended by adding the following sentence:-

A contractor’s failure to comply with this paragraph may be grounds for termination of the contract and may be punished by a fine of not more than $500 for the first offense and by a fine of not more than $1,000 for a second or subsequent offense.”; and

by inserting after section 9 the following 2 sections:-

“SECTION 9A.  Notwithstanding any other general or special law to the contrary, the fourth paragraph of section 7 of chapter 90 of the General Laws, as inserted by section 6, shall not apply to a motor vehicle, trailer, semi-trailer or semi-trailer unit that was leased or purchased by the commonwealth before January 1, 2019.

SECTION 9B.  Notwithstanding any other general or special law to the contrary, the fourth paragraph of section 7 of chapter 90 of the General Laws, as amended by sections 7 and 7A, shall not apply to a motor vehicle, trailer, semi-trailer or semi-trailer unit that is operated under a contract with the commonwealth that was entered into before January 1, 2022.”; and

in section 11, by inserting after the figure “6”, in line 72, the following words:- “and 9A”; and

in section 12, by inserting after the figure “7”, in line 73, the following words:- “, 7A and 9B”.
