Partial Fill Co-Pays
Messrs. Moore and O'Connor move that the proposed new text be amended in section 18, by striking out proposed section 17Q of chapter 32A of the General Laws and inserting in place thereof the following section:-
“Section 17Q. Any coverage offered by the commission to an active or retired employee of the commonwealth insured under the group insurance commission shall provide, for any covered drug that is a narcotic substance contained in schedule II of section 3 of chapter 94C, that if a person requests a prescription filled in a lesser quantity pursuant to section 18 of said chapter 94C any required cost sharing shall be paid at the initial prescription fill and that no further cost sharing shall be required if the remainder of that prescription is filled not later than 30 days after the date on which the prescription is written.”; and
in section 67 by striking proposed section 47JJ of chapter 175 of the General Laws and inserting in place thereof the following section:-
“Section 47JJ. Any policy, contract, agreement, plan or certificate of insurance issued, delivered or renewed within the commonwealth, which is considered creditable coverage under section 1 of chapter 111M, shall provide, for any covered drug that is a narcotic substance contained in schedule II of section 3 of chapter 94C and that is subject to cost sharing, that when a person requests a prescription filled in a lesser quantity pursuant to section 18 of said chapter 94C any required cost sharing shall be paid at the initial prescription fill and that no further cost sharing shall be required if the remainder of that prescription is filled not later than 30 days after the date on which the prescription is written.”; and
and in section 71 by striking out proposed section 8LL of chapter 176a of the General Laws and inserting in place thereof the following section:-
“Section 8LL. Any contract between a subscriber and the corporation under an individual or group hospital service plan which is delivered, issued or renewed within the commonwealth shall provide, for any covered drug that is a narcotic substance contained in schedule II of section 3 of chapter 94C and that is subject to cost sharing, that when a person requests a prescription filled in a lesser quantity pursuant to section 18 of said chapter 94C any required cost sharing shall be paid at the initial prescription fill and that no further cost sharing shall be required if the remainder of that prescription is filled not later than 30 days after the date on which the prescription is written.”; and
and in section 74 by striking out proposed section 4LL of chapter 176B and inserting in place thereof the following section:-
“Section 4LL. Any subscription certificate under an individual or group medical service agreement delivered, issued or renewed within the commonwealth shall provide, for any covered drug that is a narcotic substance contained in schedule II of section 3 of chapter 94C and that is subject to cost sharing, that when a person requests a prescription filled in a lesser quantity pursuant to section 18 of said chapter 94C any required cost sharing shall be paid at the initial prescription fill and that no further cost sharing shall be required if the remainder of that prescription is filled not later than 30 days after the date on which the prescription is written.”; and
and in section 77 by striking out proposed section 4DD of chapter 176G of the General Laws and inserting in place thereof the following section:-
“Section 4DD. An individual or group health maintenance contract that is issued or renewed shall provide, for any covered drug that is a narcotic substance contained in schedule II of section 3 of chapter 94C and that is subject to cost sharing, that when a person requests a prescription filled in a lesser quantity pursuant to section 18 of said chapter 94C any required cost sharing shall be paid at the initial prescription fill and that no further cost sharing shall be required if the remainder of that prescription is filled not later than 30 days after the date on which the prescription is written.”
