Mattress Disposal Study Commission
Ms. Donoghue, Mr. deMacedo and Ms. Gobi moved that the proposed new text be amended By inserting, after section __, the following new section:-
“SECTION __. There shall be a special commission to study the financial and environmental impacts of disposal and end-of-life management of mattresses and associated foundations on municipalities of the commonwealth. The commission shall examine existing mattress management options, including recycling and disposal infrastructure, and make recommendations on policies and programs to increase mattress reuse and recycling, and to mitigate the financial and environmental costs of managing said materials.
The commission shall review all aspects of mattress disposal and end-of-life management including, but not limited to: (i) availability of local management options; (ii) costs and burdens of existing options to taxpayers and municipalities; (iii) programs and policies of local and state government that promote proper diversion of mattresses and reduce costs; (iv) opportunities to increase additional community impacts for chronically unemployed populations through preferred partnerships with nonprofit social enterprises operating mattress recycling; and (v) programs and policies utilized in other states.
The commission shall consist of the following members: the commissioner of the Massachusetts Department of Environmental Protection, or his/her designee; 2 members of the senate, 1 of whom shall be appointed by the minority leader; 2 members of the house, 1 of whom shall be appointed by the minority leader; and 2 persons to be appointed by the governor, 1 of whom shall have experience in integrated materials management and waste management; a representative of MASSRECYCLE; a representative of the International Sleep Products Association or the Mattress Recycling Council; a representative of the Products Stewardship Institute; and a representative from a Massachusetts-based mattress recycling social enterprise program.
The commission shall file a report of its findings and recommendations with the clerks of the senate and house of representatives, the chairs of the senate and house committees on ways and means, and the chairs of the joint committee on environment, natural resources and agriculture by no later than March 1, 2018.”

Lobster Processing

"SECTION __. Section 44 of chapter 130 of the General Laws is hereby amended by striking out the third paragraph, as appearing in section 107 of chapter 38 of the acts of 2013, and inserting in place thereof the following paragraph:-
If the measurement of any such lobster taken from 1 or the other eye sockets is of the required length, such lobster shall be deemed to be a legal lobster. In all prosecutions under this section, any mutilation of any lobster which affects its measurement as aforesaid shall be prima facie evidence that the lobster was or is shorter than the required length; provided, however, that the director shall, by regulation approved by the marine fisheries advisory commission, allow the on-shore processing in the commonwealth of live lobsters of legal length into frozen shell-on lobster parts or tails and the importation of unfrozen shell-on lobster parts or tails for the purpose of further processing by wholesale dealers that are licensed by the department of public health under section 77G of chapter 94. Processed frozen shell-on lobster parts or tails may be possessed, sold or offered for sale in the commonwealth by any wholesale dealer, retail dealer or food establishments and such food product may be possessed by a consumer. The processing, possession or sale of frozen or unfrozen lobster tails pursuant to this section shall be limited to lobster tails weighing 3 ounces or more. The packaging of processed frozen or unfrozen shell-on lobster parts or tails pursuant to this section as a food product shall be labeled in accordance with applicable federal and state laws and regulations. This section shall not apply to common carriers having lobster in possession for the purpose of transportation.
This section shall take effect on April 1, 2017 during which time the Division of Marine Fisheries shall promulgate regulations, in accordance with recommendations from the 2012 Division of Marine Fisheries report entitled, "Analysis of Laws, Regulations and Policies Pertaining to the Processing, Possession and Sale of Processed Frozen Lobster Parts," to maintain enforcement of conservation rules and to ensure only legally sized lobsters are taken."

Exemptions from taxation of structures and buildings essential to the operation of agricultural and horticultural lands
Mr. Tarr, Ms. Gobi, Messrs. Fattman, Humason, Cyr, O'Connor and Timilty moved that the proposed new text be amended by inserting, after section 25, the following new section:-
"SECTION 26. Chapter 61A of the General Laws is hereby amended by striking out section 15, as appearing in the 2014 Official Edition, and inserting in place thereof the following section:-
Section 15. (a) Except as provided for in this section, all buildings located on land which is valued, assessed and taxed on the basis of its agricultural or horticultural uses in accordance with the provisions of this chapter and all land occupied by a dwelling or regularly used for family living shall be valued, assessed and taxed by the same standards, methods and procedures as other taxable property.
(b) Structures and buildings essential to the operation of lands actively devoted to the primary purpose of commercial agriculture, aquaculture, silviculture, horticulture, floriculture or viticulture and actually used and occupied to carry out such operation as set forth in section 1A of chapter 128, which are constructed or reconstructed subsequent to July 1, 2015 shall be exempt from taxation under chapter 59 to the extent of any increase in value thereof by reason of such construction or reconstruction for a period of 5 years.
The term “structures and buildings” shall include: (1) structures and buildings or portions thereof used directly and exclusively in the raising and production for sale of agricultural and horticultural commodities or necessary for the storage thereof, including structures and buildings or portions thereof used for the processing of agricultural and horticultural commodities, or the retail merchandising of such commodities produced or raised in the commonwealth; (2) structures and buildings used to provide housing for regular and essential employees and their immediate families who are primarily employed in connection with the operation of lands actively devoted to agricultural and horticultural use, but not including structures and buildings occupied as a residence by the applicant and his immediate family; (3) structures and buildings used as indoor exercise arenas exclusively for training and exercising horses in connection with the raising and production for sale of agricultural and horticultural commodities or in connection with a commercial horse boarding operation; (4) structures and buildings used in the production of maple syrup; (5) structures and buildings used in the production of honey and beeswax including those structures and buildings used for the storage of bees. For purposes of this section, the term “indoor exercise arenas” shall not include riding academies that solely provide equine riding lessons or dude ranches.
As used in this section, the term “agricultural” shall include the activity of raising, breeding and boarding of livestock, including commercial horse boarding operations.
(c) Such exemption from taxation shall be granted only upon an application by the owner of the building or structure on a form prescribed by the commissioner. The applicant shall furnish such information as such board of assessors shall require. Such application shall be filed with the assessor of the municipality having the power to assess property for taxation on or before the appropriate taxable status date of such municipality and within 1 year from the date of completion of such construction or reconstruction.
If the assessor is satisfied that the applicant is entitled to an exemption pursuant to this section, he shall approve the application. Such structures or buildings shall be exempt from taxation as herein provided.
(d) The assessed value of any exemption granted under this section shall be entered by the assessor on the portion of the assessment roll provided for property exempt from taxation. An exemption granted pursuant to this section shall continue only while the buildings and structures are actually used and occupied as provided herein, but in no event for more than 10 years.
In the event that land or buildings or structures in agricultural or horticultural use are converted to non-agricultural or non-horticultural use during the period of an exemption granted pursuant to this section, the structures or buildings upon which the exemption was granted shall be subject to roll-back taxes for the period during which the exemption was operative. Structures and buildings subject to roll-back taxes shall be taxed as provided herein.
The assessors of the appropriate assessing unit shall enter on the taxable portion of the assessment roll of the current year the assessed valuation or valuations of the structures or buildings on which exemption was granted in any prior year or years at the assessed valuation or valuations as set forth on the exempt portion of the assessment roll or rolls.
The amount of roll-back taxes shall be computed by the appropriate tax levying body by applying the applicable tax rate for each such prior year to the assessed valuation, as set forth on the exempt portion of the assessment roll, for such structures or buildings for each such prior year during such period of exemption.
Such roll-back taxes shall be levied and collected in the same manner and at the same time as other taxes are imposed and levied under this chapter."

Cranberry Wetland Mitigation Banking Program
Messrs. Rodrigues and Cyr moved that the proposed new text be amended by adding the following section:-
SECTION__. Notwithstanding any general or special law to the contrary, the Executive Office of Energy and Environmental Affairs shall establish a cranberry wetland mitigation banking program for the purposes of off-site mitigation of public or private projects subject to the wetlands protection act, General Laws chapter 131 Section 40, requiring variances or orders of conditions.
For the purposes of this section, the following words shall have the following meanings unless the context clearly requires otherwise:
“Credit”, a unit of trade representing the increase in the ecological value of the site, as measured by acreage, functions or some other assessment method.
“Pilot Cranberry Wetlands Bank” or “bank”, the development of a single wetlands bank through a public/private partnership in two or more watersheds for the assessing the effectiveness of wetlands banking as a regulatory tool to mitigate environmental impacts associated with construction activities.
Credits from the pilot cranberry wetland mitigation bank for off-site mitigation shall only be available for project mitigation after all regulatory requirements for avoiding, minimizing and mitigating impacts on site to the greatest extent practicable have been met. Off-site mitigation sites shall be located on cranberry bogs in active production in the two chosen watersheds. These sites from previously filled or drained bogs shall be the priority for off-site mitigation. Local Conservation Commissions located in the chosen watersheds under the authority of General Law chapter 131 section 40 and in agreement with project proponents may send projects requiring mitigation to the receiving bank.
Within 30 days after the effective date of this act, the Executive Office of Energy and Environmental Affairs shall issue a request for proposals for the selection of a contractor with experience in cranberry agriculture, knowledge of grower base and potential cranberry acreage available for mitigation and knowledge of the wetlands protection act to assist in the design, approval, creation, ownership and management and long term ecological monitoring of a cranberry wetlands restoration bank in the two chosen watersheds.
Within 90 days of issuing the request for proposals, the Executive Office of Energy and Environmental Affairs shall select a banking contractor. This request for proposals and selection of a contractor shall not be subject to chapter 30B of the General Laws.
Bank financing and sale of bank credits shall be subject to an agreement developed between the executive office of energy and environmental affairs and the selected contractor, subject to the review and approval of the inspector general.
The Executive Office of Energy and Environmental Affairs shall file a joint report assessing the process of establishing the pilot cranberry wetlands mitigation bank, describing the transactions and projects affected by the bank, and the effectiveness of the bank in protecting wetlands while enabling projects requiring mitigation to progress with the joint committee on environment, natural resources and agriculture within 1 year of the creation of the pilot cranberry wetlands bank and for each year thereafter, for 5 years. The report shall include information on the amount, acreage, location and types of wetlands restored and credits issued or traded, and list of all projects utilizing bank credits at the time the report is prepared. This provision shall sunset unless extended by the legislature 5 years from date of passage.

Contaminated Shellfish Fee

"SECTION XX. Notwithstanding any general or special law to the contrary, the division of marine fisheries shall determine a fee per bag for contaminated shellfish to be paid to a city or town whose coastal waters contain shellfish as defined in section 1 of chapter 130 that (i) have been removed or taken from areas declared be contaminated by the division under section 74 of chapter 130 of the general laws and (ii) transplanted to a receiving city or town for cleaning and purification in clean water. The fee, as determined by the division, shall be assessed on a city or town receiving transplanted contaminated shellfish for cleaning and purification on a per bag basis. Said city or town receiving transplanted contaminated shellfish shall pay the fee, as assessed and determined by the division under this section, to a city or town whose coastal waters contained said contaminated shellfish that were removed and transplanted to a receiving city or town."

There shall be a Metropolitan Beaches Trust Fund to be used, without further appropriation, to support free events and recreational and educational programs at the metropolitan beaches under section 70 of chapter 3. The fund shall consist of money received into the fund from any other fund or source or otherwise appropriated, donated or provided to the fund. Any balance in the fund at the end of the fiscal year shall not revert to the General Fund, but shall remain available for expenditure in subsequent future years. An expenditure made from the fund shall not cause the fund to become deficient at any point during a fiscal year.”; and
by inserting after section 100 the following section:-
“SECTION 100A. Notwithstanding any general or special law to the contrary, the department of conservation and recreation shall enter into a long-term lease agreement, not to exceed 10 years, with the metropolitan beaches commission to provide for the management and design of display banners appurtenant to property owned and identified by the department as within the jurisdiction of the commission on the future of metropolitan beaches established pursuant to section 70 of chapter 3 of the General Laws. Revenue generated from a lease or other agreement between the department and the metropolitan beaches commission shall be deposited into the Metropolitan Beaches Trust Fund established by section 35EEE of chapter 10 of the General Laws; provided, however, that the department shall receive 33 per cent of the net revenue collected through the Metropolitan Beach Trust Fund to offset the department’s costs for banner installation and maintenance and for general maintenance and operations of the metropolitan beaches. The lease and other agreements shall be on terms acceptable to the commissioner of the department of conservation and recreation and the co-chairs of the commission on the future of metropolitan beaches. The commissioner shall retain the authority, in consultation with a representative of the commission on the future of metropolitan beaches and a representative of the local community where the banners are displayed, to review and approve banner content associated with such a lease agreement.”.

Recycling standards

“SECTION __. The commissioner of environmental protection shall establish performance standards for the reduction of municipal solid waste, as described in section 2, to achieve the purposes of the solid waste master plan and greenhouse gas reduction plan and to protect the natural environment, preserve resources, achieve progress toward the commonwealth's goals to reduce greenhouse gases and create green jobs in the commonwealth. The performance standards shall be promulgated by July 1, 2018.
SECTION __. The department of environmental protection shall establish performance standards for municipal solid waste reduction on the basis of pounds per capita of solid waste disposed. The standards shall reduce solid waste to not more than 600 pounds per capita by July 1, 2019 and not more than 450 pounds per capita by July 1, 2023.
SECTION __. Not later than December 1, 2018, the secretary of energy and environmental affairs, in consultation with the department of environmental protection and the department of energy resources, shall develop a municipal solid waste standards action plan to assist municipalities in achieving the standards set forth in this act. The secretary shall review the effectiveness of existing recycling programs and other incentives available to achieve these standards and shall make any recommendations available to the public on the website of the executive office of energy and environmental affairs. Recommendations may include, but shall not be limited to, potential regulatory or statutory changes to the solid waste master plan, the Clean Energy and Climate Plan for 2020 or the green communities program. The secretary shall consult with the solid waste advisory committee in developing the plan.
SECTION __. Each city and town shall report to the department of environmental protection annually, by not later than September 1, the total weight of solid waste disposed of through the solid waste program of the city or town during the prior fiscal year, as well as the number of households and residents who participated in the program. If the department makes a determination that a city or town has not met the municipal solid waste reduction performance standards as prescribed by the department by July 1, 2019, that city or town shall submit a report to the department setting forth the reasons that the town did not meet the standards and detailing a plan to achieve the performance standards by July 1, 2023. The department shall issue a report on the municipal solid waste programs not later than December 1 of that year that provides per capita solid waste disposal statistics for the municipal solid waste programs and shall file the report with the clerks of the senate and house of representatives and the senate and house chairs of the joint committee on environment, natural resources and agriculture. The report may disaggregate solid waste tonnage information to highlight categories of waste, including waste that is beyond the control of a city or town such as waste created as a result of a natural disaster."

New Bedford State Pier
Mr. Montigny moved that the proposed new text be amended <w:p><w:r><w:t xml:space="preserve">by inserting after section 100 the following section:-
“SECTION 100A. Notwithstanding any general or special law to the contrary, the department of conservation and recreation shall transfer all ownership rights pertaining to the New Bedford state pier to the executive office of housing and economic development not later than October 31, 2017. The executive office of housing and economic development shall, following the transfer of ownership rights from the department of conservation and recreation, enter into an interagency agreement with the Massachusetts Development Finance Agency, not later than April 1, 2018, to support management and operations of New Bedford state pier. The interagency agreement shall include provisions for planned improvements to the New Bedford state pier to further economic development within the port of New Bedford by expanding the pier into a mixed-use facility capable of supporting water-dependent cargo, commercial fishing, marine transportation, marine educational facilities, fresh produce and seafood markets and other uses related to tourism and public recreation. To support mixed-use development at the New Bedford state pier, the interagency agreement shall utilize any funding appropriated pursuant to item 6720-1350 of chapter 286 of the acts of 2014.”
