Monthly Minimum Reliability Contribution

Messrs. Barrett, Cyr and Moore, Ms. Friedman and Mr. Eldridge moved that the proposed new text be amended by inserting after section ____ the following sections:-

“SECTION _____.  Subsection (d) of section 139 of chapter 164 of the General Laws, as appearing in the 2016 official edition, is hereby amended by striking out, in lines 84 and 85, the words “facilities, such as backup charges and demand charges,”, and inserting in place thereof, the following words:-  facilities such as backup charges and demand charges, including demand charges as part of a monthly minimum reliability contribution, except as allowed under subsection (j),

SECTION ______.  Subsection (j) of said section 139 of said chapter 164, as so appearing, is hereby amended by inserting after the word “system”, in line 150, the following words:- ; provided, however, that a distribution company shall not assess a demand charge that is not coincident with peak system demand; and provided, further, that a distribution company may assess a demand charge that is coincident with peak system demand only in instances in which a customer is first offered, at a reasonable cost, advanced metering equipment or equivalent technology for near real time access by the customer to electricity usage data.

SECTION ______.  Said subsection (j) of said section 139 of said chapter 164, as so appearing, is hereby further amended by striking out, in lines 175 through 177, inclusive, the words “; provided that, the date designated by the department shall be not later than December 31, 2018”

SECTION ______.  This act shall apply to any monthly minimum reliability contribution, including any monthly minimum reliability contribution approved by the department of public utilities to take effect on or before December 31, 2018.  Any monthly minimum reliability contribution previously approved must be refiled for review and approval by the department.”
