Mobile Devices In Fatal Crashes

Representatives Whelan of Brewster and Howitt of Seekonk move to amend the bill by inserting after Section 13, the following new section:

SECTION XXX.  Section 29 of said Chapter 90, as so appearing, is hereby amended by inserting after the word, “aforesaid”, in line 41, the following words:-  Whoever operates a motor vehicle upon any way or in any place to which the public has right to access, or upon any way or in any place to which the public has access as invitees or licensees, shall be deemed to have consented to an examination by the Registrar or their designee of any mobile electronic device in their possession or control in the event that said motor vehicle operator is involved in any crash which results in the death of any person.
