Amendment #6 to H3793

All Stops Amendment

Representatives Tyler of Boston, Williams of Springfield, Elugardo of Boston, González of Springfield, Barber of Somerville, Sabadosa of Northampton, Livingstone of Boston, Gouveia of Acton, Connolly of Cambridge, Lewis of Framingham, Robinson of Framingham, Higgins of Leominster, Hecht of Watertown, Farley-Bouvier of Pittsfield, Keefe of Worcester, Ciccolo of Lexington and Provost of Somerville move to amend the bill by striking out section 6 and inserting in place thereof the following section:

“SECTION 6. Chapter 228 of the acts of 2000 is hereby amended by striking in section 5 the words “at the time a citation was issued”;

and further by inserting after section 5 the following section:-

Section 5A. The registry of motor vehicles, in consultation with the executive office of public safety and security, shall review and revise the Massachusetts Uniform Citation to include a field to indicate the race of each individual subject to any and all traffic stops, searches, and frisks by a police officer, as defined under section 1 of Chapter 90 of the General Laws.”

and further by striking in section 6 of chapter 228 of the acts of 2000 the word “cited” and inserting in place thereof the word “stopped”;

and further by striking in section 8 of chapter 228 of the acts of 2000  the words “from any issues Massachusetts Uniform Citation” and inserting in place thereof the words “for all motor vehicle stops”;

and further in clause 1 of said section 8 by inserting after the word “individuals” the words “who are stopped, or”;

and further by striking section 10 of chapter 228 of the acts of 2000  and inserting in place thereof the following section:

Section 10. (a) Annually, the secretary of public safety and security shall transmit the necessary data collected by the registry of motor vehicles to an entity in the commonwealth, including but not limited to a university, non-profit organization or institution, whether private or public, with experience in the analysis of such data, for annual preparation of an analysis and of report of its findings. The secretary shall forthwith transmit the entity’s annual report to the department of the attorney general, the department of state police, the Massachusetts Chiefs of Police Association, the executive office of public safety and security and the clerks of the house of representatives and the senate.”
