Amendment #522 to H3800

Mental Health Legal Advisors Committee

Ms. Balser of Newton moves to amend the bill by adding the following section:  SECTION XXX: Section 34E of Chapter 221 of the General Laws, as appearing in the 2016 Official Edition, is hereby amended by adding to the end of the second paragraph the following sentence:

No question of whether representation is authorized under this section shall be considered in, or affect the final disposition of, any proceeding in which a person is represented by the committee or a member of its staff. A litigant in such a proceeding may refer such question to the chair of the committee, who shall review the matter in consultation with other committee members, dispose of the question promptly, and take appropriate action.
