Amendment #3 to H4012

Children's Jewelry

Mrs. Poirier of North Attleborough moves to amend the bill by the adding the following section:-

“SECTION X. Chapter 94B of the General Laws is hereby amended by inserting after section 9, as appearing in the 2018 Official Edition, the following section:-

Section 9A. (a) For purposes of this section, the following words shall, unless the context clearly requires otherwise, have the following meanings:-

“ASTM F 2923-14”, ASTM International’s Standard Specification for Consumer Product Safety for Children’s Jewelry in effect on October 1, 2014.

“Children’s jewelry”, jewelry designed or intended primarily for use by children 12 years of age or younger to be worn as an item of personal ornamentation, not including: (i) toys or other products intended for use when a child plays; (ii) accessories; (iii) apparel; (iv) footwear; or (v) any other product whose purpose is primarily functional and not ornamental.

(b) All children’s jewelry sold in the commonwealth shall meet the requirements of ASTM F 2923-14.”
