Amendment #80 to H4127

Section 35 Treatment Facilities

Ms. Decker of Cambridge moves to amend the bill by adding the following new section:--

“Section XXX. Not later than September 1, 2021, the Secretary of the Executive Office of Health and Human Services shall oversee the procurement of new facilities, including secure facilities, that treat men with an alcohol or substance use disorder under sections 1 and 35 of chapter 123 of the General Laws; provided, that said facilities be licensed and approved by the department of public health or the department of mental health; provided, further, that a sufficient number of said new facilities be established to ensure that facilities for treatment outside of a correctional institution, including such institutions as designated by the commissioner of correction and county correctional departments, are available for all persons committed under section 35 and not committed to a correctional facility pursuant to order issued in a pending criminal case under a provision of law other than Section 35; and provided, further, that said new facilities be located in geographically equitable regions in the Commonwealth.”
