Amendment #7 to H4768

Ballot Postmark Deadline

Ms. Decker of Cambridge moves to amend the bill by adding the following new section:-

 

SECTION X. (a) Notwithstanding any provision of this act or any other general or special law to the contrary, an application for a mailed absent voting or early voting by mail ballot for the November 3, 2020 state election, including an application made on the state secretary’s website under section 14, shall be seasonably filed if it is received in the office of the city or town clerk not later than noon on Friday, October 30, 2020.

(b) For the November 3, 2020 state election, the city or town clerk shall receive and count early voting by mail ballots and absent voting ballots mailed not later than November 3 if they are received not later than November 9. A legible postmark shall be conclusive evidence of the date of mailing. Otherwise, the date of the voter’s affidavit shall be the date of mailing.
