Reforming qualified immunity for law enforcement officers
Mr. Hecht of Watertown moves to amend the bill, as amended, by striking the final sentence in Section 32 and inserting in place thereof the following:-
Qualified immunity shall not apply to claims for monetary damages against law enforcement officers unless the law at the time of the conduct clearly established that the conduct was lawful.
and by adding the following new section:
SECTION X. Section 11I of said chapter 12 is amended by inserting before the existing paragraph the word:- "(a)"
and by adding the following new subsection:-
(b) In an action under this section, qualified immunity shall not apply to claims for monetary damages against law enforcement officers unless the law at the time of the conduct clearly established that the conduct was lawful.
