Further Amendment

Mr. Rogers of Cambridge moves to further amend amendment #195 by striking it out in its entirety and inserting in place thereof the following:-

Mr. Rogers of Cambridge moves to amend the bill in subsection (b) in section 32 by striking out the second sentence and inserting in place thereof the following:- Qualified immunity shall not apply to claims for monetary damages against law enforcement officers unless the law at the time of the conduct clearly established that the conduct was lawful.

And further moves to amend the bill by adding the following section:-

SECTION X. Section 11I of said chapter 12 of the General Laws is hereby amended by inserting at the end thereof the following:- In an action under this section, qualified immunity shall not apply to claims for monetary damages against law enforcement officers unless the law at the time of the conduct clearly established that the conduct was lawful.
