Amendment #20 to H4860

Community-Based Justice

Ms. Dykema of Holliston moves to amend the bill, as amended, by adding the following section:-

SECTION X. Section 32 of chapter 12 of the General Laws, as so appearing, is hereby amended by striking out the entire section and inserting in place thereof the following:-

(a) The district attorneys in the Suffolk, Middlesex, Essex, Worcester, Hampden, Hampshire/Franklin, Norfolk, Plymouth, Bristol, Cape and Islands and Berkshire counties may develop local youth violence prevention and intervention programs in coordination with school districts and community stakeholders. Said programs may incorporate restorative justice principles as defined in section 1 of chapter 276B.

(b) Schools shall not provide personal information on any student identified by programs established in subsection (a) to district attorneys without the express written consent of the student’s parent or guardian. Any individual whose information is provided in such manner shall be notified and informed of his or her right to counsel.
