Amendment #91 to H4860

Qualified Immunity Parity

Mr. Dooley of Norfolk moves to amend the bill, as amended, by inserting at the end thereof the following new section:-

“SECTION XX. Notwithstanding any general provisions or special laws to the contrary, any act or law limiting qualified immunity for any state or municipal position shall also apply to members of the legislature. This standard shall apply insomuch as a board, committee, or standard is required to enforce or allow the stripping of licensure or allowing for a civil lawsuit for said class of employees. The attorney general of the commonwealth shall establish a comparable method of oversight with equal authority to determine that the legislator’s immunity from civil suits is null and void.”
